major violations. Any subsequent or continuing major <br /> violation may be cause for termination. Termination <br /> shall be invoked if, in the Police Chief's judgment, <br /> continued participation in the Rotation Tow Program by <br /> the affected tow operator may result in a hazard to <br /> public safety and\or welfare, or the operator has been <br /> convicted of a crime listed in Section 15C. In lieu of <br /> termination, the Police Chief may impose an additional <br /> suspension. <br /> <br /> N. Except as specifically stated in the Agreement, minor <br /> violations of the Agreement may be cause for disciplinary <br /> action in the following manner. <br /> <br /> 1. First minor violation in 12 months - letter of <br /> written reprimand. <br /> <br /> 2. Second minor violation in 12 - months - 30 day <br /> suspension. <br /> <br /> 3. Third minor violation in 12 months - 60 to 90 day <br /> suspension. <br /> <br /> 4. Fourth minor violation in 12 months - termination of <br /> the Agreement. In lieu of the termination, the <br /> Police Chief may impose additional suspension. <br /> <br /> O. Nothing herein shall be deemed to prohibit the Police <br /> Chief from immediately suspending any operator whose <br /> conduct, or that of the operator's employee(s), is deemed <br /> to be a danger to the motoring public or who has engaged <br /> in conduct constituting a flagrant violation of the <br /> Agreement. <br /> <br />17. HEARING\APPEAL <br /> <br /> A. In the event the Police Chief serves the operator with a <br /> written reprimand, termination or suspension, the <br /> operator may request a hearing within seven calendar days <br /> by submitting a request in writing to the Police Chief. <br /> If a hearing is requested, it shall be held as soon as <br /> practicable. The hearing shall be conducted by the <br /> Police Chief or the Chief's designee and the operator <br /> shall be entitled to present all relevant facts and <br /> circumstances in support or the operator's position. <br /> <br /> B. Following a hearing, if the operator is dissatisfied with <br /> the Police Chief's decision, the operator may request an <br /> appeal (as defined in Attachment A) by submitting a <br /> request in writing to the Police Chief within seven <br /> calendar days. If an appeal is requested, it shall be <br /> held as soon as practicable. The appeal shall be <br /> <br /> -19- <br /> <br /> <br />
