Revocation of the use permit is also a possibility if the mitigations were <br />not effective_ Staff believes the modification of the use permit would be acceptable as <br />conditioned_ <br />Stai£believes approval of this CUP modification would allow the applicant's business to stay <br />competitive with other existing and approved bars that also serve hard liquor. Staff believed that <br />the three required findings for the conditional use permit could be n~tade and recon~tn-tcnded <br />approval of this application. <br />THE PUBLIC HEARING WAS OPENED_ <br />In response to an inquiry by Commissioner Fox regarding the service of food, Matt Billings, <br />applicant, noted that he planned to serve food from the kitchen until 10:00 p_m_, which is one <br />hour before closing_ He added that the kitchen staff begins its work day at 7.0:00 a.m. and that a <br />12-hour day was already tiring. CJommissioner Fox expressed concern that hard liquor would be <br />scrvcd without food being available. She asked the Commission and staff regarding the approval <br />of El Balazzo and related conditions of approval recently implemented by the Planning <br />Con~mission_ Staff and the Comrrtission indicated that a condition was added for El Balazzo to <br />serve food during all hours that alcohol was served. <br />Commissioner Blank concurred that he was also concerned with the lack of food when alcohol is <br />served and suggested that ready-made sandwiches and other food be made available after the <br />regular kitchen hours_ <br />Mr_ Billings agreed that he could provide some kind of food during all hours but was conccn-ted <br />with being told specifically what foods to serve. <br />THE PUBLIC HEARING WAS CLOSED_ <br />Commissioner Blank moved to make the conditiional use fiudings as listed in the staff <br />report and to approve the modification to UP-95-54, subject to the conditions of approval <br />listed in Exhibit B of the staff report, as recommended by staff, with the addition of a <br />condition that appetizers and ready-made "cold" sandwiches be available to customers at <br />all times that alcohol is scrvcd_ <br />Commissioner Fox seconded the motion "conceptually" but did not want to be more <br />specific than requiring appetizers to be served_ <br />The: notion failed for lack of a second. <br />Staff noted that the existing use permit already requires that "food items" be available to patrons <br />"during the operating hours of the business" (Condition of Approval No. 8 to UP-95-54).
