ROLL CALL VOTE <br />AV1=S: Commissioners Arkin, Slari lc, Fox, Maas, Roberts_ <br />NOES: 1Vone_ <br />ABSTAIN= None_ <br />RECUSED: None_ <br />ABSENT: None_ <br />Resolution No_ PC-2005-43 was entered and adopted as motioned. <br />7_ MATTERS INITIATED BY COMMISSION MEMBERS <br />Dire Station Dedication <br />Commissioner Roberts noted Chairperson Maas, Commissioner Peace, and she had <br />attended the dedication of the Fire Station and was unhappy that no mention was made of <br />the Planning Commission's involvement in the project. Shc recalled that the <br />Commission spent a long time on that project, particularly the green building aspects of <br />the building_ Shc noted that the Planning Commission instigated the green building <br />process for the Fire Station. <br />Kelo v. New London -Private Pro oertv Taking <br />Commissioner Fox requested further information about the State's response to the <br />L7.S. Supreme Court's recent ruling regarding the taking of private property by eminent <br />domain for commercial development use ~Kelo v. New London)_ She understood that <br />there was either a State Senate or Assembly bill being discussed to prohibit a similar <br />occurrence in California_ She requested that staff examine pending legislation and bring <br />that information to the Planning Commission for review. She would like to know if the <br />Commission was interested in supporting that bill_ <br />Commissioner Roberts believed that several California cities have already supported <br />prohibition of similar takings of private property. <br />L_ea~ue of California Cities Newsletter <br />CGommissioner Arkin noted that the League of California Cities used to send out a <br />newsletter via email regarding planning issues at the State level. Ha had not received a <br />newsletter in a while_ <br />Conditions in Permitted Uses <br />Referencing the projects at 5555 Sunol Boulevard and 3283 Bernal Avenue, <br />Commissioner Blartlc asked Ms. Nerland to provide information about whether the <br />Commission could condition a permitted use, particularly if a change in use would impact <br />traffic_ <br />Ms. Nerland advised that she would. speak with the "Traffic and Planning staff regarding <br />how these projects have been approached and provide a response to the Planning <br />Commission. <br />PLANNING COMMISSION MINUTES August 24, 2005 Page 9 of I 1 <br />
