Commissioner Blank noted that he had received a phone call From a citizen with respect <br />-- to the drag minutes, and he believed that the phrase on the last line of the fourth <br />paragraph on page 2 should read "...federal pre-emption" instead of "federal cxempiion." <br />Commissioner Blank advised that the sentence on the fourth paragraph on page 18 should <br />be modifed to read as follows, "Commissioner Blank requested that the residential fire <br />sprinklers discussion be agendized and placed urz the culerzdur crs u_lulurc, i(em." <br />Commissioner Fox advised that the third sentence of the third paragraph on page 7 should <br />be modified to read as follows= "She noted that Stone Pointe Wuy was a curved area with <br />smaller sized streets as well. She expressed a bit of-eoncern about enforceability of traFfc <br />violations, but believed that since Hacienda Security has a security ~ database, and <br />James Paxson had indicated that each security issue is reported to the City's police <br />department, it would be easy to irianage the conditional use permit." <br />The minutes were approved as corrected_ <br />3_ MEETING OPEN FOR ANY MEMBER OF THE AUDIENCE TO <br />ADDRESS THE PLANNING COMMISSION ON ANY ITEM WHICH IS <br />NOT ALREADY ON THE AGENDA_ <br />Kevin Close, 871 Sycamore Road, commented on the design review o£ a house in the <br />golf course area. He believed that the concepts of design guidelines and City standards <br />were not utilized. in that review, specifically, the guideline under Section 2, Item B, <br />Item 13, which reads, "The scale architectural style and building mass should be <br />compatible with adjacent homes and the semirural character o£the area" He reviewed <br />the Happy Valley Specific Plan and had always seen the semi-rural standard met in the <br />community. He discovered that estate-sized homes were being planned for the golf <br />course, which he believed would be problematic. He believed those homes would not <br />match the community nor any development adjacent to the golf course. He noted that the <br />design guidelines were not taxed but that the 25 percent floor area ratio ~FAR~. was fixed_ <br />He was concerned that the FAR was at its maximum limit. <br />In response to an inquiry by Commissioner Fox regarding whether this item has been <br />approved and whether there was a window open for appeal and a public hearing, <br />Mr_ Pavan replied that this was the first of the Mariposa Ranch houses to come through <br />under the new process that was approved by the City Council several months ago. <br />Notices were sent to everyone within the Happy Valley Specific Plan area, acid staff was <br />prepared to approve the project for the house with some conditions of approval_ <br />Following those procedures, staff will send to each Commissioner the approved plans, <br />approval letter, conditions o£ approval, and a cover memo going into some details o£ the <br />house. As approved by the City Council under its new process, the Planning Commission <br />has 20 calendar days to appeal the item to its level In the same manner, anyone in the <br />Happy Valley Specific Plan area has 20 days from the date of the approval letter to <br />appeal the itam_ Ha noted there was still ample tuna for an appeal to the City C_o uncil as <br />a public hearing_ <br />PLANNING COMMISSION MINUTES August 24, 2005 Page 2 of I 1 <br />
