Aooellants (PADR-1271. Beniamin <br />and Sovice Diaz) <br />Appeal of the Zoning Administrator's approval of an application for <br />administrative design review to construct an approximately 385-square-foot <br />first-floor addition and an approximately 221 -square-foot second-floor addition to <br />an existing single-family residence located at 4769 Peaceful Lane_ Zoning for the <br />property is PUD-MDR (Planned Unit Development -Medium Density <br />Residential District. <br />Ms. Decker briefly described the application acid explained that the iri atter is an appeal of <br />a Zoning Administrator approval. She introduced Ms_ Leslie Mendez, Assistant Planner, <br />to present the staff report. <br />Ms. Mendez presented the staffreport, indicating that on May 20, 2005, the Zoning <br />Administrator approved Case PARK-1277, the application of the Benjamin and Joyce <br />Diaz to build first- and second-story additions to their two-story residence. She noted <br />that the City's Landscape Architect had visited the site and had indicated that the removal <br />of the three trees would not require mitigation under the City's Tree Preservation <br />Ordinance. She stated that the proposal met all the Codc requirements, including setback <br />requirements, and that five conditions were added to address the concerns of the <br />neighbors. Ms. Mendez advised that the table on page 3 contained a typographical error: <br />the height requirement should read. 30 feet or less. She recommended that the <br />Commission deny the appeal and uphold the Zoning Administrator's approval- <br />THE PUBLIC HEARING WAS OPENED. <br />Gregory Crofton, 4757 Peaceful Lane, gave some handouts to the Commissioncrs_ I-Ie <br />commented that there is a history between the applicants and his family and that he <br />would like a fair and balanced review of the proposal to preserve his privacy and reduce <br />interaction between the two families- He pointed out on the photographs presented by <br />staff that the existing trees did not provide any buffer and added that some trees which do <br />provide a buffer and screening would be removed and a window added as well. He noted <br />that the additions would bring the Diaz's house 1 3 feet closer, and the proposed deck <br />facing toward the Cro Ron property would enable people to peek over his backyard, <br />-- thereby reducing the CroRons' privacy.
