Bob Lopercna, 5568 Paseo Navarro, noted that he lived directly adjacent to the Suttons' home to the southeast. He supported his neighbors' concerns about this application and did. not have any issue with how the Suttons' operate their day care. He was concerned about traffic, safety, and increased noise, especially during play hours. He noted that he telecommuted two days a week, and he was concerned about the effect of noise on his business- hi response to an inquiry by Commissioner Fox regarding how he distinguished noise from the daycare from that of the tot lot play area at the park, Mr. Lippirina replied that the tot lot was on the opposite side of the building, approximately 200-300 feet away- He added that it was approximately 1 5 feet to the daycare play area- Gail Loperena, 5568 Paseo Navarro, noted that her family had the most at stake during the hours that her husband must do business. She noted that she was a teacher who was ofP during the summer and that she was home all day. She noted that a year ago, the same group of neighbors had appeared before the Planning Commission requesting that the tall fence not be installed; a variance was required to allow the fence. She noted that the front yard was treated as a back yard, with the play equipment located in that area- Shc noted that she had triad to request that the customers drive safely and had sometimes received rude replies. She taught pre-school and liked young children, but hoped the increase to 14 children would not be approved. A Livermore resident and customer of the Suttons for the past year spoke in support of this item. She noted that commuted from Livermore to work and realized that the issue of 14 children has been a prominent concern; however, Mrs. Sutton has never had eight children <the current maximums there at the same time- She added that some children were only there part of the time and that some of the additional children would be new children of existing clients. Joanne Cabasian, spoke in support of this item and noted that she was a Livermore resident who taught at Foothill High School. She read her letter of support to the Commission and noted that her daughter attended the daycare one day a wank. Sha noted that the houses was immacu]~ta and that the children were well-behaved- She understood that the daycare would he expanded For the two clients who were expecting children- She noted that she drove very slowly around the curve and parked legally- Paul Machi, 5580 Paseo Navarro, did not dispute how well the daycare was operated and emphasized his concern about traffic and safety. He encouraged the Planning Commission to view the video of traffic on the street that he submitted- He noted that State law gave the City the ability to update in the event of a nuisance or safety issue, and set criteria for its approval (Section 1597.47. Kathy O'Brien, 5556 Paseo Navarro, noted that she lived three doors down from the Sutton home and had no dispute with the daycare as it currently exists, with the exception of traffic.
