Commissioner Arkin noted that there were many projects building up on the hillside <br />using the old definition, and he did not believe the definition was correct with respect to <br />those potential prof ects_ <br />ROLL CALL VOTE: <br />AYES: Commissioners Arkin, Blank, Fox, Maas and Roberts. <br />NOES: None. <br />ABSTAIN: None. <br />RECUSED: None. <br />ABSENT: None. <br />The motion passed. <br />DuClair Family/Vervais Property <br />Commissioner Fox advised that she had spoken to the DuClairs following the closed <br />session meeting and added that the house would be appraised but that it would take <br />between 30-45 days to complete the appraisal. She expressed concern that the DuClairs <br />had found a property in another city they would like to buy. She would like to agendize <br />an item to propose that a General Plan Amendment be made to change that property back <br />from Parkland to Commercial. <br />Commissioner Roberts advised that Council did not take the rezoning action. <br />Commissioner Fox noted that Steve Bocian had contacted her earlier in the day and <br />added that if the City bought the land, the land use zoning did not matter. If the City <br />Council decided not to buy the land aRer 60 days, it would take three to four months <br />before the DuClairs could sell their property. <br />In response to an inquiry by Commissioner Arkin whether this issue could be discussed <br />in closed session, Ms_ Nerland replied that she was unsure whether there would be an <br />exception to the Brown Act because the Commission was not the body negotiating for the <br />purchase of the property. She suggested that the Commission may direct staff to <br />agendize this item, if needed, aRer the City Council acts upon getting the appraisal. <br />Commissioner Fox moved to agendize a discussion proposing a General Plan <br />Amendment to rezone the DuClair property from Parkland to Commercial. <br />Chairperson Blank seconded the motion. <br />PLANNING COMMISSION MINUTES February 23, 2005 Page 14 of 17 <br />
