Christine Truesdale/W_A_ Cram. <br />Inc. <br />Appeal of the Zoning Administrator's approval of an application for design <br />review approval to install an approximately 12,000-gallon above-ground diesel <br />fuel tank for refueling vehicles/equipment and to install landscaping screening at <br />5675 Sunol Boulevard- Zoning for the property is I-P Industrial Parks District_ <br />Commissioner Fox leR the dais several times during the hearing for this item- <br />Mr_ Pavan summarized the staFF report and noted that the appeal was based on concerns <br />regarding adequate visual screening of the facility from that of the nearby trails, future <br />trails, and the houses in the KB Home development- He described the layout of the <br />proposed project and added that the proposal meets or exceeds the zoning requirements <br />of the I-P Zoning District With respect to the visual concerns, there was existing <br />landscaping in the area of the site located between the facility and that of the KB Home <br />houses. The future trail will be located in the Alameda County Transportation Corridor <br />and on the Applied Bio Systems property- In addition to the existing landscaping, the <br />applicant will install a series of trees and shrubs which can achieve a height of 1 0-30 Feet, <br />which would augment the existing landscaping and screen the facility from view- In <br />addition, the tank will be painted a brown color in order to blend into the surroundings_ <br />Staff had received comments from neighbors pertaining to the safety of this facility- In <br />addition, three neighbors did not receive notices- Staff notes that this installation is <br />-- required to secure a building permit as well as a hazardous materials storage and handling <br />permit from the Fire Department. He noted that Danielle Stefani of the Pleasanton Fire <br />Department would be able to answer any related questions- <br />With respect to the three KB Home residents who did not receive notices, Mr. Pavan <br />advised that the City's notiFication list is taken from the Alameda County tax roll records <br />of property owners within the County- He added that at times, the County is not <br />up-to-date in recording new ownerships and that in this case, the County records showed <br />that the three residences in question still listed their owners as KB Home. Upon <br />discovery of that fact, staff hand-delivered copies of the agenda and staff report to those <br />owners. Mr_ Pavan stated that to the best of his knowledge, there is no other property <br />owner or resident in that neighborhood who was not in receipt of a notice. He stated that <br />staff regrets the occurrence regarding those three neighbors and advised that the City's <br />notiFication process meets or exceeds the requirements of Statc law_ <br />Staff generally believes that the question of an above-ground tank versus an underground <br />tank contains costs and beneFits_ The underground tank raises the possibility of ground <br />water contamination iF there is a leak, while any leak in an above-ground tank can be <br />seen and remedied immediately. On the other hand, an above-ground tank raises the <br />issue of visual impacts to surrounding properties. Staff feels that the location, the tank <br />color, and the existing and new landscaping being proposed would serve to screen the <br />tank. Staff recommends that the appeal be denied and that the Planning Commission <br />-~ approve PDR-427, subject to the draft conditions of approval. <br />PLANNING COMMISSION MINUTES January 12, 2005 Page 4 of 21 <br />
