1 A_ "l,he project developer shall submit a fitzal lighting plan for the exterior building lighting <br />for the review and approval of the Ylan ning Director prior to issuance of the building <br />shell permits. Parking area lighting may be subject to a separate building permit and <br />shall be subject to the. review and approval of the Plaaming Director before issuance of a <br />building permit. <br />19. The project devEloper(s) shall pay any and all fees to which the property may be subject <br />as provided in the Developirient Agreement, as anicnded, between the property owner <br />and the City prior to issuance of building permiis. The type and amount of the fees shall <br />be those permitted under the Developmetzt Agreement, as aniendad_ <br />20_ This design review approval will lapse within one year frotra the date of approval unless a <br />building permit is issued and construction has commenced and is diligently pursued <br />toward completion or an extension has been approved by the City_ <br />21. Prior to issuance of a building permit., the project developer shall pay the required <br />commercial development school impact fee as prescribed by state law and as adopted by <br />the Pleasanton Unified Schoo] District. <br />22. The project developer acknowledges that the C7ity of Pleasanton does not guarantee the <br />availability of sufficient sewer capacity to serve this development above the atnouni of <br />sewer capacity remaining and available to developer under the City's Sewer Agreement <br />with developer, the project developer agrees and acknowled gcs th ai building permit <br />ap proval(s~ irtay be withheld if sewer capacity is found by the City not to be available. <br />23. The building permit plan check materials will be accepted for submittal only niter <br />completion of the 1 5-day appeal period, measured from the date of the approval letter, <br />unless the project developer submits a. signed statement acknowledging that the plan <br />check fees may be forfeited in the event that the approval is overturned on appeal, or that <br />ibe design is significantly changed as a result of the appeal. In no case will a building <br />permit be issued prior to the expiration of the 1 5-day time-period. <br />Planning Rcquircm cntsa <br />24. 11t no time shall balloons, batmers, pennants, or other attention-getting devices be utilized <br />on the site except as allowed under the Developnieni Agreement, as amended, between <br />the property owner and the City for grand openings and. for temporary uses as part of a <br />decorating plan in conjunction with shopping center protriotional events. <br />25. The restaurants covered by this approval shall be equipped at all times with filtering <br />devices to minimize odors and fumes. <br />4 <br />
