32. The following tree preservation nz ethods shall be followed for the existing trees Lo be preserved= <br />a. The applicant shall utilize his best efforts to locate any new utility trenches outside the <br />dripline of the- existing strcct trees Lo be saved. I£this is not Feasible, then the applicant <br />shall submit a report from a certifiied arborist acceptable to the City that indicates the <br />trenching will not be detrimental to the health of the trees_ <br />b. No oil, gasoline, chemicals, or other harmful materials shall be deposited or disposed. <br />within the dri Aline of the trees or in drainage channels, swales, or areas that iztay lead to <br />the dripline. <br />c. No signs, wires, or ropes shall be attached to the trees. <br />d. No stockpiling/storage of construction rnateri al s, till, etc., shall take place. underneath or <br />within S of the dripline of the existing trees. <br />c. No eel uipm ent or temporary structures shall be placed within or beneath the driplines o£ <br />these treas. <br />Failure to comply with these requiretncnts may result in a stop-work order. <br />33. The applicant shall cater into an agreement with the City, approved by the City Attorn cy, which <br />guarantees that all landscaping installed as part of this project, including landscaping in the City <br />parking lot, will be maintained at all times in a manner consistent with the approved land scapc <br />plan for this dcvelopn-icnt_ Said agrecn-Lent shall. run with the land for the duration o£the <br />existence of the structures located on the property. <br />34. Prior to installation o£any signs, a cornprehen live sign program shall be submitted. for sign <br />design review approval. Said sign program shall include the specific details for each sign (i.e., <br />colors, materials, illun-iination, location, sign te=xt, diLriensions, etc.. The sign program shall be <br />consistent with the regulations of the Downtown Kevitalization District and the Downtown <br />Design Guidelines_ <br />35. "I'he building permit plans shall accurately show all existing public irnprovenients near the <br />subject develop~r~aLrt ~i.e., strcct lights, strcct signs, vaults, ete.~ and shall clearly indicate any <br />proposed niodi. Fications to the existing public improvements. Proposed niodiFications to the <br />public iniprovem eats shall be subj act to review and approval by the City I/ngincar and Planning <br />Director prior to issuance of a building permit. <br />36. At no time shall balloons, banners, pennants, or other attention-getting devices be utilized on the <br />site except as allowed by Sections 1 8.74. 130 and 1 8.~J6.060K of the Zoning Ordinance For grand <br />openings or by Section 1 8. 7 7 6.040 of the Zoning Ordinance i£ approved by temporary <br />conditional use permit as part o£a decorating plan in conjunction with Downtown/Main Street <br />promotional events. At no time shall spot lighting be used after 10=00 PM in conjunction with <br />such grand openings and/or prototional events. <br />
