<br />ATTACHMENT 3 <br /> <br />IN THE CITY COUNCIL OF THE CITY OF LIVERMORE <br />STATE OF CALIFORNIA <br /> <br />AN ORDINANCE AMENDING SECTIONS I8.44.030F, 18.44.0S0E, 18.44.070, AND <br />18.44.080 OF THE LIVERMORE MUNICIPAL CODE REGARDING RESIDENTIAL <br />CONDOMINIUM CONVERSIONS TO CLARIFY INCLUSIONARY HOUSING <br />REQUIREMENTS AND TENANT RELOCATION PLANS, TO SPECIFY THE <br />MAXIMUM PERCENTAGE OF RENTAL UNITS WHICH CAN BE CONVERTED IN <br />ANY YEAR, AND TO ADD A REQUIRED FINDING <br /> <br />The Livermore General Plan Housing Element includes goals to preserve affordable housing <br />in the City, including the following: <br /> <br />. Address the diverse housing needs of ihis community through ihe provision of a range of <br />housing choices by type, price, and density to make available a sufficient supply of housing <br />for all economic segments of the community. (Housing Element, B, Goal!.) <br />. Encourage and facilitate the provision and long-term availability of housing affordable 10 all <br />economic segments ofihe communily. (Housing Elemenl, B, Goal 3.) <br />. Preserve and improve the existing affordable housing stock and neighborhoods. (Housing <br />Element, B, Goal 4.); and <br /> <br />This same concern is already reflected in the condominium conversion regulations which <br />state in part that ihe purpose ofthe regulations is to "provide a reasonable balance of ownership and <br />rental housing and a variety of choices" and "maintain a supply of renlal housing for low income and <br />moderate income persons". (Livermore Municipal Code section 18.44.010.); and <br /> <br />There is evidence that in the Bay Area some property owners are purchasing apartment <br />buildings wiih the purpose of converting them 10 condominium units, and ihen selling ihose units for <br />the high prices which for-sale housing now commands. This reduces ihe supply of rental housing in a <br />community, and reduces Ihe ability of renters to find housing in ihe City; and <br /> <br />The City wishes to strengihen its residential condominium conversion regulations to assure <br />ihat renlal housing will not be losl in ihe conversion process; and <br /> <br />The Planning Commission considered this proposed amendment at ils meeting on June 7, <br />2005 and voted to recommend approval by the City Council (Planning Commission Resolution no. <br />21-05). <br /> <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF LIVERMORE DOES <br />ORDAIN AS FOLLOWS: <br /> <br />o 7-dS" dOOS <br /> <br />1./.02.., <br /> <br />-1- <br /> <br />25 <br />
