<br />Section J. A new subsection F is added to Section J 8.44.030. Procedures [for Residential <br />Condominium Conversions}, of the Livermore Municipal Code to read asfollows: <br /> <br />"18.44.030 Procedures. <br /> <br />F. Inclusionary housing. A condominium conversion is subject to the inclusionary <br />housing requirements in LMC section 18.32.035. However, if the project was required 10 <br />comply with the inclusionary housing requirements when the project was constructed, the project <br />shall receive a credit for: (I) the number of affordable units required at the time the project was <br />constructed, assuming those existing affordable units remain affordable units; and (2) any fees <br />paid in lieu of creating affordable unils, as to that portion of the obligation under the then-current <br />inclusionary housing requirements that may be satisfied by the payment of fees." <br /> <br />Section 2. Subsection E of Section J 8.44.060, Tenant Provisions [for Residential Condominium <br />Conversions], of the Livermore Municipal Code, is amended to read asfollows: <br /> <br />"18.44.050 Tenant Provisions. <br /> <br />E. Tenanl Relocation Plan - Assistance. <br />I. Relocation and Assistance Plan. The subdivider shall submit a lenant relocation and <br />assislance plan with the tenlative map application. The plan shall include the information <br />consislent with the State of California Relocation Assislance Act (Government Code <br />Sections 7260-7277) and the Federal Uniform Relocation Assistance and Real Property <br />Policies for Federal and Federally Assisted Programs Act (United States Code Title 42, <br />Chapter 61) and those additional provisions required under this subsection. <br />2. Vacation of Units. <br />a. Each nonpurchasing tenant, not in defaull under the rental agreement or <br />lease, shall have not less than 180 days from the date of receipt of notification from the <br />subdivider of the intent to convert, or from the filing date of the final subdivision map or <br />parcel map, whichever date is later, 10 find Subslitute housing and to relocate. <br />b. A nonpurchasing tenant who: (a) is handicapped, or (b) has minor children <br />in school, or (c) is age 60 or older (whether publicly subsidized or not) and does not <br />accept a lifetime lease, living in any unit al the time a completed tentative map <br />application is accepted by the department, shall be given at leasl an additional six months <br />(or until the end of the school year for tenants with minor children in school, which ever <br />is longer) after approval of the final map in which to find suilable replacement housing. <br />3. Other Available Rentals. The subdivider shall provide each tenanl not wishing 10 <br />purchase a unit or not accepting a lifetime or special three-year lease with up-to-dale <br />informalion of available apartments of comparable size and price, and localed wilhin a 15- <br />mile radius of the apartment to be converted, and shall provide transportation to assist each <br />elderly or handicapped tenant in finding alternative housing. <br />4. No increase in Rents. A lenant's rent shall not be increased during Ihe period <br />between the filing of the tentative map and the tenant's relocation or acceplance ofa lifetime <br />or special three-year lease, or the denial or withdrawal of the map. <br /> <br />ORDINANCE NO. <br /> <br />-2- <br /> <br />26 <br />
