The director of planning and <br />communily developmenl may waive Ihe requirement for submitlal of an affordable <br />housing proposal for projects approved prior to Ihe effective date hereof and/or for <br />projects that have undergone considerable public review during which affordable housing <br />issues were addressed. <br /> <br />The affordable housing proposal shall be reviewed by the cily's housing commission al a <br />properly nOliced meeling open to the public. The housing commission shall make <br />recommendalions 10 Ihe cily council either accepting, rejecling or modifying Ihe <br />developer's proposal and the utilization of any incentives as ouilined in this chapter. The <br />housing commission may also make recommendations 10 Ihe planning commission <br />regarding Ihe projecI as necessary to assure conformance wilh this chapler. <br /> <br />Acceptance oflhe applicant's affordable housing proposal is subjecllo approval by the <br />city council, which may direcllhe city manager to execule an affordable housing <br />agreemenl in a form approved by the city atlorney. The cily manager or his/her designee <br />shall be responsible for monitoring Ihe sale, occupancy and resale of inclusionary units. <br />(Ord. 1818 ~ 1,2000) <br /> <br />17.44.100 Conflict OfInterest: <br /> <br />The following individuals are ineligible to purchase or rent an inclusionary unit: a) cily <br />employees and officials (and their immediate family members) who have policymaking <br />aulhority or influence regarding cily housing programs; b) the project applicanl and ils <br />officers and employees (and their immediate family members); and c) the projecl owner <br />and ils officers and employees (and Iheir immediate family members). (Ord. 1818 ~ 1, <br />2000) <br /> <br />17.44.110 Enforcement: <br /> <br />The city manager is designated as the enforcing authorily. The cily manager may suspend <br />or revoke any building permil or approval upon finding a violation of any provision of <br />Ihis chapler. The provisions of Ihis chapler shall apply 10 all agenls, successors and <br />assigns of an applicant No building permit or fmal inspeclion shall be issued, nor any <br />development approval be granted which does not meet the requiremenls of this chapter. <br />In the event that il is determined Ihal rents in excess of those allowed by operation of this <br />chapler have been charged to a tenant residing in an inclusionary unil, Ihe cily may take <br />appropriale legal aclion to recover, and Ihe project owner shall be obligated to pay 10 Ihe <br />lenant, or to the city in the evenl the tenanl cannol be located, any excess renls charged. <br />(Ord. 1818 ~ 1,2000) <br /> <br />17.44.120 Appeals: <br /> <br />Any person aggrieved by any aclion or delerminalion of Ihe city manager under this <br />chapter, may appeal such aclion or delerminalion to the cily council in the manner <br />provided in chapter 18.144 of this code.
