The occupancy and rents of the off- sile inclusionary units shall be governed by <br />the terms of a deed reslriclion, and if applicable, a declaration of covenants, <br />condilions and restriclions similar to that used for ibe on-sile inclusionary unils. <br />The affordable housing agreesmenl shall stipulate ibe lerms ofthe off-sile <br />inclusionary unils. If the construclion does nol take place at the same lime as project <br />development, the agreement shall require Ihe units to be produced within a specified <br />lime frame, bul in no evenllonger Ihan five (5) years. A cash deposil or bond may be <br />required by Ihe city, refundable upon construction, as assurance Ihat Ihe unils will be <br />buill. <br />B. Land Dedicalion: An applicanl may dedicale land 10 the city or a local nonprofil <br />housing developer in place of aclual construclion of inclusionary units upon approval <br />of Ihe cily council. The intenl of allowing a land dedication oplion is to provide the <br />cily or a local nonprofil housing developer the free land needed to make an <br />inclusionary unit developmenl feasible, Ihus furthering Ihe intenl oflhis chapler. <br />The dedicaled land musl be approprialely zoned, buildable, free of toxic substances <br />and contaminated soils, and large enough 10 accommodate the number of <br />inclusionary units required for the project The cily's acceptance of land dedicalion <br />shall require thai the lols be fully improved, with infrastructure, adjacenl ulililies, <br />grading, and fees paid. <br />C. Credil Transfers: In Ihe event a project exceeds the total number of inclusionary unils <br />required in Ihis chapter, Ihe project owner may request inclusionary unit credils <br />which may be used 10 meet the affordable housing requirements of another project <br />Inclusionary unit credits are issued to and become Ihe possession of the project <br />owner and may nol be Iransferred to another projecI owner withoul approval by the <br />cily council. The number of inclusionary unit credils awarded for any project is <br />subjecl to approval by Ihe cily council. <br />D. Alternate Methods Of Compliance: Applicants may propose crealive concepls for <br />meeting Ihe requiremenls oflhis chapler, in order 10 bring down the cosl of providing <br />inclusionary unilS, whether on- or off-site. The cily council may approve alternate <br />methods of compliance wilh this chapter if Ihe applicant demonstrates that such <br />alternate method meets the purpose oflhis chapler (as sel forth in section 17.44.020 <br />ofthis chapter). <br />E. Lower Income Housing Fee Oplion: In lieu of providing inclusionary units in a <br />projecl, an applicant may pay the city's lower income housing fee as sel forth in <br />chapter 17.40 of this title.
