For single-family residential projecls which meel the <br />affordability threshold with moderate income unils, or multiple-family residenlial <br />projects which do nol meel the affordabilily threshold, only the inclusionary unils shall be <br />eligible for a waiver of Ihe lower income housing fee excepl as otherwise approved by <br />Ihe city council. <br /> <br />To assure affordabilily over the life oflhe unit, Ihe affordable housing agreemenl shall be <br />recorded wilh Ihe property deed or olher method approved by the city attorney. In the <br />event an inclusionary unit is affordable by design the affordable housing agreemenl shall <br />slipulale the melhod for assuring Ihat the unils retain Iheir affordability as Ihe housing <br />markel changes. <br /> <br />The direclor of planning and community development may waive Ihe requirement for an <br />affordable housing agreemenl for projects approved prior 10 Ihe effeclive hereof and/or <br />for projecls Ihat have their affordable housing requirements included in a developmenl <br />agreement or other city document (Ord. 1818 S 1,2000) <br /> <br />17.44.070 Incentives To Encourage On-Site Construction Of <br />Inc1usionary Units: <br /> <br />The city shall consider making available 10 Ihe applicant incenlives to increase Ihe <br />feasibilily of residential projecls 10 provide inclusionary unils. Incentives or fmancial <br />assislance will be offered only to Ihe extent resources for this purpose are available and <br />approved for such use by the city councilor cily manager, as defmed below, and 10 Ihe <br />extenllhat the project, with the use of incenlives or fmancial assislance, assists in <br />achieving the cily's housing goals. However, nOlhing in Ihis chapler establishes, direcily <br />or Ihrough implication, a righl of an applicant to receive any assislance or incentive from <br />Ihe city. <br /> <br />Any incenlives provided by Ihe cily shall be set out in Ihe affordable housing agreement <br />pursuant 10 section 17.44.060 ofthis chapter. The granting of the additional incentives <br />shall require demonstration of exceplional circumstances that necessitate assistance from <br />Ihe city, as well as documentation of how such incentives increase the feasibilily of <br />providing affordable housing. <br /> <br />The following incentives may be approved for applicanls who conslrucl inclusionary <br />unils on-sile: <br /> <br />A. Fee Waiver Or Deferral: The cily council, by resolution, may waive or defer <br />payment of cily developmenl impact fees and/or building permit fees applicable to <br />the inclusionary units or Ihe projecl of which they are a part. Fee waivers shall meet <br />the crileria included in Ihe cily's adopled policy for evalualing waivers of cily fees <br />for affordable housing projecls. The affordable housing agreement shall include Ihe <br />terms of Ihe fee waiver. <br />B. Design Modifications: The granling of design modifications relalive to the <br />inclusionary requirement shall require Ihe approval of the cily council and shall meet <br />all applicable zoning requiremenls oflhe cily of Pleas anion.
