However, Ihe cily may require Ihallhe inclusionary unils meet <br />certain minimum slandards. These standards shall be set forth in the affordable <br />housing agreement for the project. <br />D. Inclusionary unils shall remain affordable in perpetuity Ihrough recordalion of an <br />affordable housing agreement as described in section 17.44.060 ofthis chapter. <br />E. All inclusionary units in a projecl shall be construcled concurrenily within or prior 10 <br />the construclion of the project's markel rale unils. <br />F. (Ord. 1818 g 1,2000) <br /> <br />17.44.060 Affordable Housing Agreement: <br /> <br />An affordable housing agreement shall be enlered into by the cily and Ihe project owner. <br />The agreement shall record the melhod and lerms by which a projecl owner shall comply <br />wilh the requiremenls of this chapler. The approval and/or recordalion ofthis agreement <br />shall lake place prior 10 fmal map approval or, where a map is nol being processed, prior <br />lolhe issuance of building permits for such lots or units. <br /> <br />The affordable housing agreement shall slale the melhodology for delermining a unit's <br />inilial and ongoing renl or sales and resale price(s), any resale reslrictions, occupancy <br />requiremenls, eligibility requiremenls, cily incentives including second mortgages, <br />recaplure mechanisms, Ihe administralive process for moniloring unil management to <br />assure ongoing affordability and olher matlers related to the developmenl and retenlion of <br />Ihe inclusionary units. <br /> <br />In addition to the above, the affordable housing agreement shall set forth any waiver of <br />the lower income housing fee.
