<br /> <br />17.44.040 General Requirements/Applicability: <br /> <br />A. Residential Development: For all new multiple-family residential projects of fifteen <br />(15) units or more, at least fifteen percenl (15%) of the projecl's dwelling units shall <br />be affordable to very low, and/or low income households. For all new single-family <br />residenlial projecls of fifteen (15) unils or more, alleast Iwenty percenl (20%) of the <br />project's dwelling units shall be affordable 10 very low, low, and/or moderate income <br />households. These dwelling units shall be referred to as "Inclusionary Units". Special <br />consideralion will be given 10 projecls in which a significant percenlage oflhe <br />inclusionary units are for very low and low income households. The specific mix of <br />unils within the Ihree (3) affordability calegories shall be subjecllo approval by the <br />city. <br />The inclusionary unils shall be reserved for rent or purchase by eligible very low, <br />low, and moderale income households, as applicable. Projecls subjecl to Ihese <br />requirements include, bul are not limiled 10, single-family delached dwellings, <br />townhomes, apartmenls, condominiums, or cooperalives provided Ihrough new <br />conslruclion projects, and/or through conversion of rentals to ownership unils. <br />The percenlage of inclusionary units required for a particular projecI shall be <br />determined only once on a given projecl, at the time of tentative map approval, or, <br />for projecls nol processing a map, prior 10 issuance of building permit Iflhe <br />subdivision design changes, which resulls in a change in Ihe number of unil types <br />required, the number of inclusionary units required shall be recalculaled to coincide <br />with the fmal approved project In applying and calculaling the fifteen percenl (15%) <br />requiremenl, any decimal fraction less than or equal to 0.50 may be disregarded, and <br />any decimal fraclion greater than 0.50 shall be conslrued as one unit <br />B. Commercial, Office, And Induslrial (cor) Developmenl: In lieu of paying Ihe lower <br />income fee as sel forth in cily ordinance 1488, cor development may provide <br />affordable housing consistent with Ihis chapter. As a result, new cor developmenls <br />are slrongly encouraged 10 submil an affordable housing proposal as set forth in <br />seclion 17.44.090 of this chapter. Upon submiltal of the affordable housing proposal, <br />cily staff will meel wilh Ihe developer 10 discuss Ihe pOlential for providing <br />incentives 10 encourage on-site construction of affordable housing unils and <br />allemalives to conslructing affordable units as sel forth in this chapler. In Ihe evenl a <br />developer requests incentives or alternalives as a means of providing affordable <br />housing in connection with a cor development, the affordable housing proposal will <br />be reviewed as set forth in seclion 17.44.090 of this chapler.
