9. This approval does not guarantee the availability o£ suti-icient water to serve the project <br />The. City shall withhold building permits For the project it at the titZ-tc building permits are <br />applied for, mat~datory water rationing is in affect, unless the City has adopted a water <br />offset program and unless the project developer is participating in the program. <br />Notwithstanding the project developer's participation in such a pro grarn, the City nay <br />withhold building permits if the City determines that sufficicut water is not available at <br />the: time of application of building permits. <br />1 (~_ The building permit plan check materials will be accepted For submittal only after <br />completion of the iiiteen- (1 5) day appeal period, measured irom the date of the approval <br />letter, unless the project developer submits a. signed statement acknowledging that the <br />plan check fees may be forfeited in the event that the approval is overturned on appeal, or <br />that the design is signi$cantly changed as a result of the appeal hz no case will a <br />building permit be issued prior to the expiration of the fifteen (15) day titrte-period. <br />7 1 . Yroof of cotrtpliance shall be provided to the Director of Building <br />Inspection prior to the issuance of final occupancy. During demolition and construction, <br />the project developer shall mark all trash disposal bins ^irash materials only" and all <br />recycling bins "recycling materials only". The project developer shall contact Pleasanton <br />Garbage Service for all waste disposal. Only that portion of trash and recycling waste <br />refused by Pleasanton Garbage Service shall be disposed of or diverted by another <br />trash recycling company. <br />7 2. The public art piece on this site shall be subject to review a.~zd approval by the C7ity's <br />Civic Arts Cotrttrtission prior to installation. <br />1 3. If additional hours of operation or acti viCies beyond that proposed in the "1'roj ect <br />Narrative," dated "Received" August 2, 2005, on i31e with the Plamiing Department, are <br />desired, prior City review and approval is required. Such modifications shall be <br />submitted to the Planning Director, who may approve the tr~odii3cation or refer the niattcr <br />to the Ylamiing Commission ii'_judged to be substantial. <br />1. 4. If operation of-this use results in cont7icts pertaining to noise, parking, traft3c/circulation, <br />odors, or other factors, at the discretion. on the Plartiting Director, this conditional use <br />permit may be su bnzitted to the Platming Commission £or its subsequent review at a <br />public hearing.
