<br />FIRST AMENDMENT <br />TO CONTRACT FOR CONSULTANT SERVICES: <br />Winzler and Kelly Consulting Engineers <br /> <br />This First Amendment, dated February 7, 2006, amends the "Contract for Consultant Services for Design <br />Services for the Pimlico Turnout, CIP No.011012 and Stoneridge Waterline, CIP NO. 031016 Projects, (C-04- <br />092) entered into on September 21, 2004 between the CITY OF PLEASANTON and Winzler and Kelly <br />Consulting Engineers (the "Original Contract"). <br /> <br />RECITALS <br /> <br />The parties desire to amend the Original Contract to provide additional design services for the Pimlico <br />and Stoneridge water projects. <br /> <br />NOW, THEREFORE, in exchange for mutual consideration, the receipt and value of which is <br />hereby acknowledged, the parties agree as follows: <br /> <br />1. The Scope of Work described in Exhibit "A" to the Original Agreement shall be <br />Amended to include additional work as described in Exhibit "8". <br /> <br />2. The Scope of Work described in the Original Agreement shall be further amended to include an <br />increase in the not-to-exceed contract amount of$73,142. The total not-to-exceed contract amount is <br />$419,342. <br /> <br />3.
