The lot sizes of the majority of homes, and certainly of the subject <br />address, are not of adequate size to accommodate the recreational <br />needs of so many children on a repeated, daily basis. As such, <br />planned and regular use of the 'small tot' playground located in the <br />common area (near to the clubhouse/pool) or linear park will be the <br />most likely end result. <br /> <br />3. The playground areas mentioned in item 2 above were designed & <br />constructed to serve the occasional needs & use of the small <br />residential community in which they are located-- not a day-care <br />business. <br /> <br />4. The community Association can be held liable for any injury or <br />accident incurred in the common areas of the community.
