12. <br /> <br />This approval does not guarantee the availability of sufficient water to serve the project. <br />The City shall withhold building permits for the project if at the time building permits are <br />applied for, mandatory water rationing is in effect, unless the City has adopted a water <br />offset program and unless the developer is participating in the program. Notwithstanding <br />the developer's participation in such a program, the City may withhold building permits if <br />the City determines that sufficient water is not available at the time of application of <br />building permits. <br /> <br />13. <br /> <br />The intersection of Hopyard Road and Gibraltar Drive shall be modified in the following <br />manner: <br /> <br />The existing traffic signal shall be modified to accommodate the fourth leg of the <br />intersection. Before issuance of a building permit, the developer shall enter into an <br />agreement with the City of Pleasanton for the maintenance and repair of the traffic <br />signal and detector loops serving the fourth leg of the intersection. The agreement <br />shall be reviewed and approved by the City Attorney. <br /> <br />The driveway entrance shall be configured as shown on Exhibit "D". The final de- <br />sign shall be submitted to the Planning Director and City Engineer for review and <br />approval before issuance of a building permit. <br /> <br />Restriping of Gibralter Drive at its intersection with Hopyard Road to allow the out- <br />bound through movement. <br /> <br />Construction of the intersection improvements shall be completed prior to the building's <br />occupancy. <br /> <br />14. <br /> <br />The line-of-sight distance from the northemmost driveway for drivers leaving the site <br />shall be verified to the satisfaction of the City's Traffic Engineer. If the sight distance is <br />inadequate, the driveway shall be configured as an entrance driveway only <br /> <br />15. <br /> <br />Except for the modifications required by the installation of deeeleration lanes from Hop- <br />yard Road, the herre/landscape areas located in the public service easement areas shall re- <br />main unchanged. <br /> <br />16. <br /> <br />Before issuance of a building permit, the developer shall execute a lease agreement with <br />the owner of the adjacent parking garage for use of forty (40) parking spaces. The lease <br />shall be submitted to the City Attorney for review and approval. <br /> <br />17. <br /> <br />Before issuance of a building permit, the developer shall record cross-access ingress/ <br />egress easements with the adjacent property owners.
