Prior to issuance of a building permit, the developer shall pay the required commercial <br />development school impact fee as prescribed by state law and as adopted by the Pleasan- <br />ton Unified School District. <br /> <br />Prior to issuance of a building permit, the applicant shall submit a detailed sign design <br />program for the project subject to review and approval by the Planning Director. Only <br />low freestanding signs may face Hopyard Road. All signs shall be consU'ucted of individ- <br />ual, halo-lit or flood lit letters mounted directly to the sign monument. <br /> <br />The developer shall submit a final lighting plan for the building and site for the review <br />and approval by the Planning Director before issuance of building permits. Lighting shall <br />be directed away from the residences located on the south side of Stoneridge Drive. <br /> <br />10. <br /> <br />The property owner or its successors in interest (owner) shall enter into a deferred im- <br />provement agreement with the City of Pleasanton (City) to provide that: <br /> <br />the owner shall either not protest the establishment of an assessment dislxict, or <br />shall affirmatively vote for the creation of the district or other mechanism to pay the <br />consu'uction costs for the 1-680/West Las Positas Boulevard fleeway interchange, <br />depending on the manner of creation of the funding mechanism; <br /> <br />the owner retains the right to protest that the allocation of costs among various <br />properties is inequitable under the above-mentioned funding mechanisms; <br /> <br />Ce <br /> <br />in the event the assessment mechanism appears to impose economically infeasible <br />levels of costs upon the site, the City agrees to explore alternative financing meth- <br />ods; and <br /> <br />if, with consent by the owner, Section VIII of the previous agreement between the <br />City and Robert E. Meyer, dated June 22, 1982 and recorded as Document No. <br />82-140679, is substantially changed so that it no longer coincides with the wording <br />of this condition, that this condition shall be superseded by the revised agreement. <br /> <br />The above-stated agreement shall also apply to any alternative program to the 1-680/West <br />Las Positas Boulevard interchange approved by the City Council to mitigate long-term <br />traffic levels-of-service on north Pleasanton freeway interchanges, streets, and/or inter- <br />sections. <br /> <br />11. <br /> <br />The developer acknowledges that the City of Pleasanton does not guarantee the availabil- <br />ity of sufficient sewer capacity to serve this development by the approval of this case, and <br />that the developer agrees and acknowledges that building permit approval may be with- <br />held if sewer capacity is found by the City not to be available. <br /> <br />8R.'97:04 <br />Exhibit "C" (PUD-80-16-14D) <br /> <br />January 21, 1997 <br /> Page 2 <br /> <br /> <br />
