He did not submit any :forms
requesting modification before or after the install o:fthe a-wning until after the Board contacted Mr.
Fisher regarding the unapproved installation.

The HOA Board's architecural poistion is not to approve any requests :for canvas or metal patio covers,
retractable or permanent. It is the their opinion that such covering do not "fit" vvith the general
architecture of the development. '

If I recall correctly, the installation of the a-wning vvas first brought to the board's attention by a neighbor
complaint. I vvas VP of the board at the tin.e. We notified Mr. Fischer. He submitted a request. We
denied the request as vve did not approve of the a-wning as a patio cover.

I thought the matter vvas concluded. Having received the public notice, I see that it is not. I plan on
attending the meeting tonight. I thought it vvas set Jor Thursday. That is vvhy this is late.

Mark Voegele
IpYoegele@sbcg1obaLneJ
1693 Holly Circle
Pleasanton, CA 94566

EXHIBIT

H

10/26/2005
