Using this con- <br /> figuration, up to a four-foot difference between the living and garage floor elevations is <br /> achieved. <br /> Public Notice <br /> Notices of the Planning Commission's public hearing on this item were sent to the property <br /> owners located within 1,000-feet of the subject property and within the entire Happy Valley <br /> Specific Plan area. Staff notes that the publi<; hearing notice for this appeal incorrectly stated <br /> the size ofthe house at 6,764 square feet ofliving area and 1,623 square feet of garage area. As <br /> approved by the Zoning Administrator, the proposal now subject to the Planning Commission's <br /> review includes 6,901 square feet of living area and 876 square feet of garage area. Corrected <br /> public hearing notices have been sent. <br /> ENVIRONMENTAL ASSESSMENT <br /> The appellant states that the development of this site will negatively impact the groundwater re- <br /> serves by infiltration of pollutants derived from the new landscape and vehicles parked on the <br /> site. Staff first notes that the project is a design review application and that, absent unusual cir- <br /> cumstances not present here, environmental issues are not proper subjects for appeal. Neverthe- <br /> less, environmental review for the proposed project was undertaken with the Final Environ- <br /> mental Impact Report (EIR) approved by the City Council for the Happy Valley Specific Plan <br /> (HVSP) in conformance with the standards of the California Environmental Quality Act <br /> (CEQA). The FEIR examined impacts to groundwater resources. <br /> The proposed project would be the design review of a single-family home in conformance to the <br /> Mariposa Ranch Design Guidelines, which were originally approved in conjunction with the <br /> Callippe Golf Course PUD development plan found by the City Council to be in conformance <br /> with the HVSP and the FEIR. Therefore, the approval of this home would not constitute a sub- <br /> stantial change to the specific plan or to the circumstances under which the specific plan is being <br /> undertaken that would involve new significant environmental effects or that would substantially <br /> increase the severity of previously identified effects. Furthermore, there is no new information <br /> of substantial importance, which was unknown at the time that the FEIR was approved by the <br /> City Council regarding the project or its effects, mitigation measures, or alternatives.
