<br />City Council Appeals <br />Believing that the Planning Commission's action would be appealed to the City Council and that <br />the appeal would be submitted on the very last day of the appeal period, the applicant appealed <br />the Planning Commission's action early-on in order to place the item on the November 15th City <br />Council agenda. Otherwise, the item would be delayed to the City Council's December 61h pub- <br />lic hearing. Jerry Wagner submitted his appeal of the Planning Commission's action to the City <br />Council on the last day of the appeal period. His reasons for the appeal are attached. <br />Staff notes that the applicant has reviewed and finaled the floor areas for the proposal: 6,785 <br />square feet of living area and 992 square feet of garage area totaling 7,777 square feet. The pub- <br />lic hearing notice for this appeal includes these floor areas. <br />Further analysis on the "Action of the Zoning Administrator" and the "Review Procedures" fol- <br />lowed for this application in conformance to the Mariposa Ranch design guidelines is described <br />in the attached Planning Commission staff report. <br />II. SITE DESCRIPTION AND SURROUNDING USES <br />The subject property is a 28,314 square foot (0.65-acres) parcel. It is a vacant site, gently sloping <br />downward towards Clubhouse Drive, and directly faces Lot 10 on the opposite side of Clubhouse <br />Drive and obliquely faces the No. 3 fairway of the golf course. Surrounding uses include the <br />Callippe Preserve Golf Course, vacant land zoned for single-family homes on various-sized lots, <br />and permanent open space. <br />III. PLANNING COMMISSION PUBLIC HEARING <br />On October 19, 2005, the Planning Commission heard PAP-87, the appeal by Jerry Wagner of <br />the Zoning Administrator's approval of PDR-482. Jerry Wagner (6344 Alisal Street), Vanessa <br />Kawaihau (871 Sycamore Road), and Kevin Clouse (871 Sycamore Road) spoke in favor of the <br />appeal. The applicant, David Quartaroli, his architect, Terry Townsend, and Roger Manning <br />(1300 Happy Valley Road) spoke in opposition of the appeal. Minutes of the public hearing are <br />attached. <br />The Commission's discussion and queries to staff during the public hearing focused on the pro- <br />posal's conformance to the Mariposa Ranch design guidelines and the nitrate issue. Staff stated <br />that the proposed project conformed to the design guidelines. With respect to nitrates, staff <br />stated that there are no changed circumstances to warrant changing the original conditions. <br />The Planning Commission voted 4-0-1 (Commissioner Anne Fox abstained) to deny the appeal <br />thereby upholding the Zoning Administrator's approval ofPDR-482. <br />SR 05:320 <br />Page 3 of 8 <br />
