<br />SUMMARY: <br /> The home proposed by the applicant conforms to the Mariposa Ranch Design Guidelines <br /> and achieves a high level of design quality. The design was peer-reviewed in confor- <br /> mance with the procedures established by the design guidelines and was then approved by <br /> the Zoning Administrator. The design review approval was appealed by Jerry Wagner and <br /> the Planning Commission upheld the Zoning Administrator's action at a public hearing. <br /> The applicant appealed the Commission's action to the City Council only in order to be <br /> placed on this hearing agenda. After the applicant appealed the Commission's action, <br /> Jerry Wagner submitted his appeal of the Planning Commission's action. <br />Honorable Mayor and Members of the City Council: <br />I. BACKGROUND <br />Background <br />This is the second house of the 34 custom homes planned for the Mariposa Ranch development at <br />the Callippe Preserve Golf Course. It is the first house processed under the new design review <br />procedures established by the City Council for this development with PUD-98-16-3M. <br />Following the review procedures set forth in the Mariposa Ranch design guidelines, the proposal <br />was first reviewed by David Bogstad of the architectural firm of Loving and Campos. After be- <br />ing approved by Mr. Bogstad, it was then submitted to the Planning Department. The Zoning <br />Administrator approved Case PDR-48 on September 7,2005. As stipulated by the City Council, <br />there was a 20-day appeal period of the Zoning Administrator's action. <br />Planning Commission Appeal <br />The project was appealed to the Planning Commission with concerns related to tlte following: <br /> . The proposed residence is too large and not in keeping with the intent of the Happy <br /> Valley Specific Plan (HVSP); <br /> . The floor area ratio (FAR) outlined in the HVSP has been exceeded; and, <br /> . The development of the site will negatively impact the groundwater reserves by infil- <br /> tration of pollutants derived from the new landscape and vehicles on the site. <br />The Planning Commission denied the appeal at its public hearing, thereby upholding the Zoning <br />Administrator's approval. <br />SR 05:320 <br />Page 2 of 8 <br />
