aware of, and abides by, all conditions of approval. It is the responsibility of the <br />applicant/property-owner to ensure that the project landscape contractor is aware of, and <br />adheres to, the approved landscape and irrigation plans, and all conditions of approval. <br />Prior approval from the Planning Department is required before any changes are <br />constituted in site design, grading, housing design, housing colors or materials, fence <br />material, fence location, landscape material, etc. <br /> <br />Landscaping and Tree Preservation <br /> <br />12. <br /> <br />A final landscape plan and irrigation plan shall be submitted to and approved by the <br />Planning Director as part of the building permit plan set prior to issuance of a building <br />or on-site permit. Said landscape plan shall be consistent with the approved landscape <br />plan plus any conditions of approval, and shall be detailed in terms of species, location, <br />size, quantities, and spacing. <br /> <br />13. <br /> <br />All trees used in landscaping shall be a minimum of 15 gallons in size and all shrubs a <br />minimum of 5 gallons, unless otherwise shown on the approved landscape plan, or <br />unless required as a condition of approval. <br /> <br />14. <br /> <br />Prior to issuance of a building permit, the site plan shall be modified to clearly indicate <br />the trees scheduled for removal and the trees to be preserved on the site. These <br />modifications shall be subject to review and approval by the Planning Director. <br /> <br />15. <br /> <br />No trees shall be removed other than those specifically designated for removal on the <br />approved plans or in the tree report, unless othem'ise approved by the Planning Director. <br />The applicant shall post cash. letter of credit, or other security satisfactory to the Planning <br />Director in the amount of $5.000 for each heritage Valley Oak tree required to be <br />preserved (Tree #295 and Tree #299). This cash bond or security shall be retained for one <br />year following acceptance of public improvements or completion of construction, <br />whichever is later, and shall be forfeited if the trees are destroyed or substantially <br />damaged. <br /> <br />16. <br /> <br />The project developer shall make every, effort to preserve Tree #296 located along the <br />retaining wall at the front of the property; if it cannot be saved the amount of the value of <br />the tree shall be placed by the project developer into the Urban Forestry Fund. <br /> <br />17. <br /> <br />Prior to issuance of a building permit, a temporary chain link fence or equivalent <br />construction fence shall be installed around the base of Trees//297 and #299 as shown <br />on the Tree Survey Map prepared by HortScience and around the three oak trees located <br />immediately east of the western property line on the Kottinger Drive frontage in <br />McKinley Park. This fencing shall be as far from the tree stem (trunk) as possible, <br />completely surrounding the tree, and 6-8 feet in height. Fencing shall remain in place <br /> <br /> <br />
