(2) <br /> <br />(3) <br /> <br />Sectored Units <br /> <br />costs associated with the City's 6onsulting architect's <br />participation in this final review process. <br />The final colors and materials shall be submitted for the <br />review and approval of the Planning Director prior to the <br />issuance of a building permit for any of the homes. <br />Modifications to the primary structures shown in the <br />development plan shall be reviewed by the Planning Director <br />as design review applications, following the City's <br />administrative design review process then in existence. Any <br />modification must be consistent with the "Vineyard Village <br />Architectural Design Guidelines." <br /> <br />This PUD Development Plan approval shall function as a conditional use <br />permit for the second units which may be constructed at the time of initial <br />construction, as shown on the Avignon MDR house plotting plan. The <br />following requirements shall apply: <br /> <br />Only one (1) residential unit on the subject property may be rented. <br />The other unit shall be owner-occupied. The dwelling's owner shall <br />be signatory to any lease for the second unit. The second unit shall <br />be occupied by no more than two (2) adults, although there shall be <br />no limit on the number of children. The project developer shall <br />prepare a deed restriction to this effect for these lots and shall submit <br />it to the City Attorney for review and approval prior to recordation <br />of the first final subdivision map. <br />In no case shall the second unit be sold, subdivided, or held under <br />different legal ownership from the primary residence. <br />One (1) off-street parking space shall be made continuously <br />available to the occupant(s) of the second unit for parking. In the <br />event that the occupant(s) of the second unit own and operate more <br />than one (1) auto, all vehicles shall be accommodated on-site. <br />The project developer shall install address signs that are visible from <br />the street, clearly indicating that two (2) separate units exist on the <br />parcel. The project developer shall obtain the new street address for <br />the second unit from the Planning DePartment. <br /> <br />The second units for these lots shown on the house-plotting plan shall <br />constitute the only second units approved with this PUD Development <br />Plan. Any future second unit located on another lot covered by this PUD <br />Development Plan approval shall be required to secure a Conditional Use <br /> <br />Conditions of Approval for PUD-6, Centex Homes' Avignon Project <br />City Council Meeting, June 5, 2001 Page 10 <br /> <br /> <br />
