16. <br /> <br />17. <br /> <br />18. <br /> <br />19. <br /> <br />20. <br /> <br />21. <br /> <br />22. <br /> <br />23. <br /> <br />B~efore issuance of a building permit on Lots t through 3, the project <br />d:leveloper/property owner shall complete a biotic survey of the property areas <br />toutside of the building envelope areas to determine the presence of habitat for <br />'threatened or endangered species. The biotic survey shall be completed by a <br />licensed biologist and shall be submitted to the Planning Director for review. <br />Should the survey indicate that the property contains habitat for threatened or <br />endangered species, then the biologist shall recommend uses and/or other <br />mitigation measures for those areas outside the building envelope to mitigate <br />impacts on said habitat. The Planning Director shall refer the biologist's <br />recommendations to the California Department of Fish and Game for review and <br />comment. The Planning Director shall incorporate into the project the biologist's <br />recommendations plus any California Department of Fish and Game mitigation <br />measures to reduce the project's impacts on the open space areas of the project. <br />Alter construction is completed, the project developer/property owner shall re- <br />inventory the sites and report the findings back to the Planning Director. All <br />inventories/findings shall be reported back to the Planning Commission. <br /> <br />Any proposed outdoor lighting for the subject property shall be of low intensity, <br />less than a 70 watt point source, in order to minimize its visibility. Outdoor <br />lighting shall also not glare onto adjacent properties. <br /> <br />The applicants are encouraged to comply with the energy efficiency guidelines of <br />the U.S. Green Building Council, where applicable, and to incorporate Green <br />Building concepts for use of recycled materials and diversion of waste materials. <br /> <br />Prior to installation of the proposed storm drain line, the applicants shall obtain <br />and/or provide proof of a drainage easement from the adjacent property owner at <br />4100 Foothill Road (Yee) allowing the proposed storm drain line to connect at the <br />access road. The text of this easement shall be subject to the review and approval <br />of the City Attorney and Planning Director. <br /> <br />At the time that the access road off Foothill Road is realigned per the approved <br />PUD plan for the Equus Court development (PUD-98-01), or as modified in the <br />future, the applicants shall abandon the portions of the access easement that <br />would no longer be necessary. <br /> <br />Specific Conditions For Proposed House on Lot 1 <br /> <br />Final inspection by the Planning Department of the structure, grading, and <br />preservation of existing trees is required prior to occupancy of the house. <br /> <br />All landscaping indicated on the plans shall be installed by the <br />applicant/homeowner prior to occupancy. <br /> <br />The plan check materials will be accepted only alter the effective date of the <br />project approval (30 days from City Council adoption of the ordinance), unless <br /> <br /> <br />
