<br />31. Trees less than 6 inches in diameter which are on the shared property line with the <br />vacant lot immediately to west shall not be removed, unless prior approval is <br />granted by the property owner of the vacant lot to the west. Prior to the issuance <br />of a building permit, the applicant shall clearly show these trees on the plans. The <br />fence and retaining wall plan shall be modified such that trees on the property line <br />shall not be impacted. <br /> <br />32. Prior to the issuance of a building permit, the applicant shall hire an arborist on the <br />City's list of approved arborists to develop tree preservation measures for the <br />existing oak tree in the front yard of 730 Peters A venue located near the shared <br />property line with unit C-4. The applicant shall implement all tree preservation <br />measures recommended by the arborist prior to demolition, grading, and <br />construction. After one year following acceptance of public improvements or <br />completion of construction, whichever is later, if the tree is substantially damaged <br />or destroyed the applicant shall replace the damaged or destroyed tree with a <br />minimum of one 36 inch box tree of the species of the property owner's choice in <br />approximately the same location. <br /> <br />33. The applicant is encouraged to preserve or relocate the existing Colorado blue <br />spruce tree on site located by the intersection of St. John St. and Peters Avenue. <br /> <br />Landscaping <br /> <br />34. The applicant shall provide root control barriers and four inch (4") perforated <br />pipes for street trees and trees in planting areas less than ten feet (10' 0") in width. <br /> <br />35. All trees used in landscaping, shall be a minimum of fifteen (15) gallons in size <br />with the exception of three of those trees which shall be 24" box as determined by <br />the Planning Director. Shrubs shall be a minimum of five (5) gallons. <br /> <br />36. The applicant's final landscape and irrigation plan shall be submitted to and <br />approved by the Planning Director as part of the building permit plan set prior to <br />the issuance of an on-site permit. Said landscaping plan shall be consistent with <br />the approved landscape plan, as shown in Exhibit "A", plus any conditions of <br />approval, and shall be detailed in terms of species, location, size quantities, and <br />spacing. <br /> <br />Noise <br /> <br />37. Prior to the issuance of a building permit, the applicant shall revise the plans such <br />that all of the dwelling units clearly adhere to a 45DNL interior noise level. Prior <br />to the issuance of a building permit, the applicant shall retain a noise consultant on <br /> <br />7 <br />
