<br />b. With the exception of motor vehicle storage and storage inside the storage <br />sheds shown on Exhibit A, there shall be no storage under the carports; <br /> <br />c. Residents living in the project are encouraged to park on-site in their driveways <br />or on-site parking spaces. On each of the single-family detached lots, there are <br />three on-site parking spaces available. The on-street spaces fronting the project <br />are not reserved for residents or any particular property or use. <br /> <br />d. The property is located in the Downtown area where businesses such as <br />restaurants, nightclubs, hotels, and theaters are open late at night. These and <br />other nearby uses may create noise, parking, and other impacts. <br /> <br />e. The maintenance association shall provide for inspection, maintenance, and <br />reporting of storm water treatment measures. <br /> <br />The proposed CC&Rs shall be subject to the review and approval of the City <br />Attorney prior to the recordation of a Final Map for the project. <br /> <br />Existing Trees <br /> <br />29. The applicant shall comply with the tree preservation recommendations of the tree <br />report prepared by HortScience dated "June 25, 2004". No tree trimming or <br />pruning other than that specified in the tree report shall occur. The applicant shall <br />arrange for the horticultural consultant to conduct a field inspection prior to <br />issuance of demolition and grading permits to ensure that all recommendations <br />have been properly implemented. The consultant shall certify in writing that such <br />recommendations have been followed for trees #83, #86, #88, and the existing oak <br />tree in the front yard of 730 Peters A venue located near the shared property line <br />with unit C-4. <br /> <br />30. Trees #83, #86, and #88 as shown on the tree report prepared by HortScience <br />dated "June 25, 2004", and the existing oak tree on the property at 730 Peters <br />A venue by the shared property line with unit C-4 shall be preserved. If permission <br />is granted by the property owner of the vacant property immediately to the west, <br />tree #88 may be relocated to another location on the property, subject to the prior <br />review and approval of the Planning Director. The applicant shall post cash, letter <br />of credit, or other security satisfactory to the Planning Director in the amount of <br />five thousand dollars ($5,000) for each tree required to be preserved, including the <br />oak tree at 730 Peters A venue up to a maximum of twenty-five thousand dollars <br />($25,000). This cash bond or security shall be retained for one (1) year following <br />acceptance of public improvements or completion of construction, whichever is <br />later, and shall be forfeited if the trees are destroyed or substantially damaged. <br /> <br />6 <br />
