PAP-80, Grel!orv and Nancv Crofton, Appellants (PADR-1271, Beniamin <br /> and Jovce Diaz) <br /> Appeal of the Zoning Administrator's approval of an application for <br /> administrative design review to construct an approximately 385-square-foot <br /> first-floor addition and an approximately 221-square-foot second-floor addition to <br /> an existing single-family residence located at 4769 Peaceful Lane. Zoning for the <br /> property is PUD-MDR (Planned Unit Development - Medium Density <br /> Residential) District. <br />Ms. Decker briefly described the application and explained that the matter is an appeal of <br />a Zoning Administrator approval. She introduced Ms. Leslie Mendez, Assistant Planner, <br />to present the staff report. <br />Ms. Mendez presented the staff report, indicating that on May 20, 2005, the Zoning <br />Administrator approved Case PADR-1271, the application ofthe Benjamin and Joyce <br />Diaz to build first- and second-story additions to their two-story residence. She noted <br />that the City's Landscape Architect had visited the site and had indicated that the removal <br />of the three trees would not require mitigation under the City's Tree Preservation <br />Ordinance. She stated that the proposal met all the Code requirements, including setback <br />requirements, and that five conditions were added to address the concerns of the <br />neighbors. <br />Ms. Mendez advised that the table on page 3 contained a typographical error: the height <br />requirement should read 30 feet or less. She recommended that the Commission deny the <br />appeal and uphold the Zoning Administrator's approval. <br />THE PUBLIC HEARING WAS OPENED. <br />Gregory Crofton, 4757 Peaceful Lane, gave some handouts to the Commissioners. He <br />commented that there is a history between the applicants and his family and that he <br />would like a fair and balanced review of the proposal to preserve his privacy and reduce <br />interaction between the two families. He pointed out on the photographs presented by <br />staff that the existing trees did not provide any buffer and added that some trees which do <br />provide a buffer and screening would be removed and a window added as well. He noted <br />that the additions would bring the Diaz's house 13 feet closer, and the proposed deck <br />facing toward the Crofton property would enable people to peek over his backyard, <br />thereby reducing the Croftons' privacy. He requested that additional trees be planted to <br />provide screening between the houses, particularly for the deck. He also proposed that <br />frosted glass be used for the transom window and that a wall be required on the side of <br />the deck that faces the Crofton home to direct the view from the deck to the rear of the <br />Diaz's yard rather than to the Croftons' backyard. He further requested that should the <br />addition be approved, that a seYeR feot tall fence Be installea the Croftons be allowed to <br />install a seven-foot tall fence for privacy. <br />Mr. Crofton questioned Condition No.6, which required the applicant to use the same <br />materials as those ofthe existing residence.
