He also inquired if Mr. Diaz, who is <br />an engineer, can approve his own plans, and noted that the site plan does not show what <br />trees would be actually removed. <br />Ms. Nancy Crofton, 4757 Peaceful Lane, stated that she concurred with her husband's <br />statements. She requested that Condition NO.7 be amended to exclude Saturday from <br />the allowed construction days, thereby limiting construction days to Monday through <br />Friday. <br />Bob and Joyce Diaz, 4769 Peaceful Lane, stated that, in response to Mr. Crofton's <br />privacy concern, the addition would provide a sufficient amount of privacy. He noted <br />that half of the windows currently facing the Croftons residence will be eliminated with <br />the addition. He then showed some photographs on the screen and explained the <br />proposed additions in detail. He noted that the existing deck which overlooks the entire <br />Crofton backyard haG been part of the 20 year 016 hOllse was part of the original house <br />design and had been there for over 20 years, and that He added that this would now be <br />enclosed to build an exercise room, and a new deck, farther out but in the same elevation, <br />would be added to preserve an existing window. <br />Joyce Diaz explained that the proposal is to enclose a notch in the garage to provide an <br />exercise room where the deck currently sits. She indicated that the new second-story <br />window is a clerestory window to be located six feet from the floor level, solely to <br />provide light in the room; the window on the first-floor would be at the approximate <br />height of the fence and, therefore, would not provide any view towards the Croftons' <br />backyard. She added the proposed deck will be a private deck and not for entertaining. <br />She stated that the City's Landscape Architect was aware that three trees were to be <br />removed for the addition. She indicated that one of the trees is actually outside the <br />construction area but too close to the project such that it will eventually die because its <br />roots will need to be cut. <br />Ms. Diaz informed the Commission that the negative feelings between the neighbors go <br />both ways. She noted that their proposed addition is small and they have plenty of trees. <br />She added that she did not feel their project is a significant imposition on the Croftons <br />and would have no real impact on them. <br />THE PUBLIC HEARING WAS CLOSED. <br />Commissioner Roberts expressed concern about the removal of the three liquid amber <br />trees and proposed that the applicant replant two liquid amber trees by the comer ofthe <br />house close to the deck. She added that she was not opposed to a seven-foot tall fence. <br />Commissioner Blank commented that three trees should be replanted since three trees <br />would be removed.
