<br /> Emergency Response Management Network <br /> Data Sharing Agreement <br />b) Disclaimers notices, if applicable, will be provided to the OES by each <br /> Participant and shall be included in the metadata associated with the <br /> data provided by the Participant through this Agreement. <br />4. Data Maintenance and Update <br />Each Participant is responsible for maintaining the currency and accuracy of the <br />data bases/resources that it makes available to other Participants through this <br />Agreement. <br />a) Each Participant will maintain the metadata associated with each data <br /> resource that the Participant makes available to other Participants <br /> through this Agreement. <br />b) Geospatial metadata shall conform to NSDI metadata standards. <br />c) Each Participant shall inform the OES and other Participants of any <br /> changes to data base or data resource Application Program Interfaces <br /> (API) as soon as is practical. <br />5. Use Restrictions <br />Each Participant agrees to use the data or information provided through this <br />Agreement only for the purposes of Participants fulfilling their respective missions <br />and providing better service to the public. In particular, the following use <br />restrictions apply to all Participants to the Agreement: <br />a) No Participant will transfer, store or download data from another <br /> Participant to recreate any other Participant agency's data without <br /> permission from the source Participant. <br />b) Each Participant has the responsibility to specify any restrictions to <br /> Data that is to be shared with any other Participant. These restrictions <br /> shall be provided to the OES in writing and specified in the Data <br /> Resource Exhibit provided by each Participant. <br />c) Each Participant is responsible for ensuring that only their authorized <br /> ERMN users get access to data made available under this Agreement. <br />d) Each Participant is responsible for compliance with information privacy <br /> and data security laws and policies <br />e) Should any Participant detect unauthorized use or access to any other <br /> Participant's data, they shall inform the Participant(s) whose data may <br /> have been accessed by unauthorized personnel. <br />f) No Participant shall use the data from another Participant for non- <br /> ERMN applications unless the source Participant agrees in writing. <br /> Such use shall then be conducted outside of the terms and conditions <br /> of this Agreement. <br /> July 5, 2005 <br />
