74. <br /> <br />75. <br /> <br />that the change docs not reveal any new significant adverse environmental <br />impact not previously identified in the Final EIR. <br /> <br />(i~) <br /> <br />If new significant adverse environmental impacts not previously identified <br />in the Final EIR are identified as a result of any required change to the <br />Project, Property Owner, at its discretion, may submit an application <br />seeking an amendment to the Specific Plan and MVTM to accommodate <br />development replaced by the mitigation area. <br /> <br />(b) <br /> <br />Mitigation lbr loss of existing seasonal/emergent wetlands and other waters shall <br />be provided at a replacement ratio as required by the Corps, but no less than <br />1:1 (created: filled). <br /> <br />(c) <br /> <br />Mitigation shall aim to achieve equivalent or higher habitat values than those <br />areas being replaced. <br /> <br />(d) <br /> <br />If required by the Corps, the Mitigation Plan shall include site preparation and <br />re-vegetation procedures, an implementation schedule, funding sources, final <br />success criteria, long-term management and maintenance responsibilities, <br />monitoring requirements, and contingency measures. <br /> <br />Strearnbed Alteration Agreement. If needed, Property Owner shall obtain any <br />necessary 1603 Streambed Alteration Agreements from California Department offish <br />and Game prior to approval of grading permits tbr any grading activities that will alter <br />stream zones and drainage charmels under State regulatory jurisdiction, <br /> <br />(a) <br /> <br />Property Owner shall submit to the Plam~ing Director a letter from the <br />Department offish and Game, the Corps, or other appropriate agency (or the <br />actual permit or agreements) indicating that necessary permits for altering or <br />filling jurisdictional watercourses have been obtained, based on proposed grading <br />or improvement plans, or that such permits are not required. <br /> <br />(b) <br /> <br />Conditions imposed on any required 1603 Streambed Alteration Agreements shall <br />become conditions of applicable grading permits. <br /> <br />Red-Tailed Hawk Nest Survey. If pursuant to Condition 38 (f), it is determined that a <br />possible impact upon nesting hawks may occur, Property Owner shall px~pare and submit <br />a Red-Tailed Hawk Nest Report to the Planning Director. The purpose of such report <br />shall be to confirm the potential active use of an existing red-tailed hawk nest within the <br />large valley oak tree along the eastern edge of Arroyo de la Laguna.
