39. <br /> <br />(e) <br /> <br />Property Owner shall conduct preliminary hazardous materials studies designed to <br />locate the presence of any hazardous materials on site, with emphasis on those <br />areas used for sludge disposal. If these studies disclose the presence of hazardous <br />materials which pose a significant threat to public health and safety, it shall <br />coordinate a remediation plan wSth the City and Alameda County Health Services. <br />Property Owner shall implement applicable recommendations as may be legally <br />required. The studies also shall include a radiological study of the site. The <br />radiological study shall be undertaken in consultation with the Radiologic Health <br />Branch of the California Department of Health Services (CDHS). The study shall <br />be peer reviewed by the City, with a public hearing on its findings prior to its <br />becoming final. The final study shall include those areas of the site determined by <br />the CDHS to require additional study. Property Owner shall implement the <br />recommendations made by CDHS regarding the scope and conduct of the <br />radiological study and shall incorporate any mitigations recommended by CDHS <br />and the City peer reviewer following their review of the completed study. <br /> <br />Property Owner shall conduct a red-tailed hawk nest survey prior to any grading <br />activity in the southern half of the Western Area as required by Condition 75, if <br />determined by the Planning Director that such grading may potentially affect a <br />nesting site. If it is determined that red-tailed hawk nesting is occurring during <br />the time Ii'amc of proposed grading activity, then improvements in the vicinity of <br />the nest should be coordinated with representatives of the California Department <br />offish and Game to minimize disturbance and possible loss of the active nest <br />during the nesting time. This coordination should include establishment of a <br />buffer area around the nesting site within which land development activities (such <br />as grading and other construction activities) and land uses are restricted. 'Ire <br />buffer area should extend 50 feet from the base of the trunk or 25 feet from the <br />drip line of the tree in which the nest is located, whichever is greater. <br /> <br />(g) <br /> <br />Property Owner shall conduct a cultural resources survey within any areas directly <br />affected by proposed grading activity as described in Condition 41. Additional <br />cultural resource monitoring and mitigation strategies may be required, as further <br />described in Conditions 42 and 43. <br /> <br />Requirements for Grading Activities. The following provisions shall apply to all <br />grading activities within the Project, and shall be a condition of all grading permits issued <br />within the Project: <br /> <br />(a) <br /> <br />Property Owner shall provide assurance that all soils affected by grading will be <br />brought to a stable and erosion-resistant state in the event that the Project is <br />prematurely terminated. The guarantee for this assurance shall be in the forro ora <br />performance bond in an amount equal to the construction bid price, which shall be <br />provided to City prior to issuance ora grading permit. <br /> <br />Conditions of Approval Page 20 of 49 Revised August 21, 2000 <br /> <br /> <br />
