32. <br /> <br />33. <br /> <br />34~ <br /> <br />35. <br /> <br />(b) <br /> <br />Maintenance and, as necessary, scheduling of events shall be done by the Property <br />Owner of the aparm~ent project, Parcel 10. <br /> <br />Regional Trails. Property Owner shall provide landscaping, fencing, or other <br />appropriate buffer to minimize conflicts between users of the Transportation Corridor <br />planned trail and adjacent private uses on Parcel 19. <br /> <br />(a) <br /> <br />Property Owner shall coordinate its construction of the planned emergency <br />vehicle access (EVA) within the Transportation Corridor with the City and East <br />Bay Regional Park District so as to create with this EVA a portion of the regional <br />trail improvements. <br /> <br />In-Lieu Park Fees. Property Owner shall pay to the City the difference between the total <br />in-lieu park fees generated by the Phase I development of the Property and $650,000, the <br />Parcel 3 park improvement cost which shall be a credit against total park fees, The total <br />in-lieu park fees shall be adjusted to reflect any fee waiver granted by the City to <br />below-market-rate units within the project. The fee due for each residential final map <br />shall be calculated (adjusted for inflation per City ordinance) and shall be due at the time <br />of approval of such a final map, offset by the credit and any fee waivers, unless the <br />Development Agreement sets forth a different payment mechanism. <br /> <br />(a) <br /> <br />Should the City and Property Owner agree to park improvements on Lot 3 in <br />excess of $650,000, any such excess shall also be a credit against the total in-lieu <br />fee due. <br /> <br />E. Grading <br /> <br />Grading Prior to Annexation. Grading shall be allowed to occur prior to annexation <br />with the specific approval of the City. Any pre-annexation grading allowed by the City <br />shall also meet the following conditions: <br /> <br />(a) <br /> <br />Property Owner shall submit all grading plans to City for review and approval <br />simultaneously with County applications. <br /> <br />(b) <br /> <br />Property Owner shall pay all standard City review and inspection fees, and <br />grading operations shall be monitored by City according to standard City practice. <br /> <br />(c) <br /> <br />City shall seek cooperation of Alameda County for City to provide sole <br />responsibility for inspection and grading plan check duties. <br /> <br />Site Grading Plan Conditions. Grading operations on the Project may be conducted <br />only upon approval of a grading permit issued by the City. Grading permits may be <br />issued at any time following approval of this PUD Development Plan, and prior to filing <br /> <br />Conditions of Approval Page 17 of 49 Revised August 21, 2000 <br /> <br /> <br />
