31. <br /> <br />(ii) <br /> <br />Property Owner shall begin construction of the park prior to or at the time <br />of the issuance of the 116t~ building permit on Parcel 2. Should the <br />construction bid, coupled with other costs, exceed $650,000, the Property <br />Owner shall be entitled to modify the park improvements, in conjunction <br />with City review and approval of the adjustments, to meet the total cost <br />limit. The City and Property Owner may agree, however, to construct a <br />park costing in excess of $650,000 by crediting any excess against the <br />Property Owner's in-lieu park fee obligation. Once begun, construction <br />shall be expeditiously pursued so as to complete the park improvements <br />within a reasonable time. <br /> <br />(iii) <br /> <br />Once the park improvements are completed, the City shall accept the <br />dedication and improvements. The Property Owner shall develop the Village Commons (Parcel 9) <br />in conjunction with the development of the apartment project on Parcel 10. The <br />commons shall be open to the public. <br /> <br />(a) <br /> <br />The design of the Village Commons shall be synchronized with the <br />commemial/office plaza and shall create a rich, usable space for both residents <br />adjoining the commons and office workers. Elements should include a focal point <br />along Valley Avenue, seating, both shaded and unshaded, lawn area, and a <br />landscape plaza area. The design should strive to create an urban, pocket park <br />feel which uses richness in the landscape/architectural palette to offset its small <br />size.
