<br />Recommendation to the Board reo PDA input on Kimberlv Commons Development <br />Given that it is important to: <br />1. Maintain consistent application of the City Parking regulations, and <br />2. Encourage downtown development, particularly infill projects <br />And that, <br />~ The second slot in each tandem parking driveway of this proposed project does not <br />constitute a legal parking slot under the City Parking Regulations, but <br />~ The Kimberly Commons project is subject to PUD rules which are not bound by the <br />current City Parking code, <br />The following mitigation items should be implemented to alleviate the burden of the additional <br />parking requirements this project will place on a vital transition area between the business <br />district and residential district: <br />I. Zone, sign and enforce parking time limits on the streets in the surrounding area to <br />strongly encourage and ensure the tandem spaces are used as designed. <br />2. Require a disclosure covenant about the impacts and value ofliving in the downtown <br />environment, where businesses such as restaurants, night clubs, hotels, and theaters are <br />open late, to prevent potential future conflict between the residential and business uses in <br />the transition area. <br />3. Include a covenant regarding the permissible, and impermissible, uses of the carports for <br />various types of storage due to the use of carports instead of garages. <br />Amendment #4 <br />If the city cannot ensure that the tandem parking places are used as designated, the PDA would <br />have serious reservations regarding tandem parking. <br />The PDA Parking Committee clarified that it does not want time-limited parking along all of <br />Peter's Avenue, for this is where Downtown employees park. The request is for time-limited <br />parking in front of the applicants' project, and potentially some surrounding areas if appropriate. <br />The Parking Committee also clarified that when the PDA reviewed this project, it supported the <br />applicants' commitment to mitigate the off-site parking demand by contributing to the "In Lieu <br />Parking Fund". The parking fund is a set aside fund to be used to acquire properties identified <br />in the Downtown Specific Plan that can meet parking needs. <br />Case No. PUD-37 Planning Commission <br />Page -19- <br />
