If permission is granted by the property owner of the <br /> vacant property immediately to the west, tree #88 may be relocated to <br /> another location on the property, subject to the prior review and approval of <br /> the Planning Director. The applicant shall post cash, letter of credit, or <br /> other security satisfactory to the Planning Director in the amount of five <br /> thousand dollars ($5,000) for each tree required to be preserved, including <br /> the oak tree at 730 Peters Avenue up to a maximum of twenty-five <br /> thousand dollars ($25,000). This cash bond or security shall be retained for <br /> one (I) year following acceptance of public improvements or completion of <br /> construction, whichever is later, and shall be forfeited if the trees are <br /> destroyed or substantially damaged. <br />31. Trees less than 6 inches in diameter which are on the shared property line <br /> with the vacant lot immediately to west shall not be removed, unless prior <br /> approval is granted by the property owner of the vacant lot to the west. <br /> Prior to the issuance of a building permit, the applicant shall clearly show <br /> these trees on the plans. The fence and retaining wall plan shall be <br /> modified such that trees on the property line shall not be impacted. <br />32. Prior to the issuance of a building permit, the applicant shall hire an arborist <br /> on the City's list of approved arborists to develop tree preservation <br /> measures for the existing oak tree in the front yard 01'730 Peters Avenue <br /> located near the shared property line with unit C-4. The applicant shall <br /> implement all tree preservation measures recommended by the arborist <br /> prior to demolition, grading, and construction. After one year following <br /> acceptance of public improvements or completion of construction, <br /> whichever is later, if the tree is substantially damaged or destroyed the <br /> applicant shall replace the damaged or destroyed tree with a minimum of <br /> one 36 inch box tree of the species of the property owner's choice in <br /> approximately the same location. <br />33. The applicant is encouraged to preserve or relocate the existing Colorado <br /> blue spruce tree on site located by the intersection of St. John St. and Peters <br /> Avenue. <br />Landscaping <br />34.
