south developed, but that agreement was not finalized. Standard Pacific apparently did not pursue <br />the matter, because of staffing changes. However, with the large Ponderosa/Busch subdivision, <br />the oversized storm drain line again came to staff's attention. A reimbursement fee was collected <br />by staff, but has not been distributed to Standard Pacific pending authorization for this <br />Reimbursement Agreement. <br /> <br />The Reimbursement Agreement provides that the City will only collect fees for the oversized <br />storm drain line from those benefited properties that are subdivided or issued a building permit <br />that will increase impervious surface area on commercial/industrial property after September 1, <br />2003. The City will not attempt to collect the fee for any prior projects given a balancing of <br />fairness to those prior projects that did not have notice of the fee and the fact that Standard <br />Pacific had not pursued approval of a reimbursement agreement until recently. As is common <br />with the City's reimbursement agreements, the term of this Agreement will expire 10 years after <br />the City accepted the public improvement, which in this case would be April 1, 2006.
