REIMBURSEMENT AGREEMENT FOR <br /> STORM DRAINAGE IMPROVEMENTS <br /> (Standard Pacific's Garden Villages Project) <br /> <br /> THIS AGREEMENT is entered into at Pleasanton, California, this __ day of <br /> __, 2005, by and between the CITY OF PLEASANTON, a general law city <br />("City") and STANDARD PACIFIC OF NORTHERN CALIFORNIA, a California limited <br />parmership ("Developer"). <br /> <br /> A. Developer was the owner and the developer of certain real property in the City of <br />Pleasanton, County of Alameda, State of California, commonly known as "Garden Villages I", <br />Tract 6593, recorded April 17, 1995, in Map Book 219, Pages 11-15 Alameda County Records <br />("Property"). <br /> <br />B. In 1996, Developer constructed an oversized storm drain line to benefit the <br />Property. <br /> <br /> C. To the extent that some portion of the storm drain line exceeds the requirements <br />for Developer's Garden Villages Project and benefits properties in the vicinity, the City has <br />agreed to attempt to seek reimbursement from these properties, with the undcn'standing that the <br />City will not seek reimbursement from any benefited properties that have already subdivided or <br />issued a building permit prior to September 1, 2003. <br /> <br /> NOW, THEREFORE, it is agxeed as follows: <br /> <br /> 1. Improvements. Developer constructed a 54-inch reinforced concrete storm drain <br />pipeline and related improvements (" Improvements"), which benefit other properties in addition <br />to the Property. Developer is entitled to recover some of the costs of the Improvements from <br />other property owners who benefit from the Improvements when the benefited properties <br />develop as set forth below. <br /> <br /> 2. Reimbursable Costs. The amount of the reimbursement shall be based upon the <br />estimates of construction cost included in Exhibit "A," which is attached and incorporated. <br /> <br /> 3. Ownership of Improvements. Pursuant to the Subdivision Agreement between <br />the City and D~eveloper, City shall own the Improvements after the Improvements are accepted <br />by the City Council. The Developer shall have the right to connect and use the Improvements in <br />accordance with City regulations, and the right to reimbursement of a portion of the construction <br />costs as provided herein. <br /> <br /> 4. Benefit Area. The properties that will benefit ("Benefit Area") from the <br />Improvements shall include those properties listed on Exlfibit "B" and shown on Exhibit "C". <br /> <br /> <br />
