That the proposed location of the conditional use <br />and the conditions under which it would be operated <br />or maintained will not be detrimental to the public <br />health, safety, or welfare, or materially injurious <br />to the properties or improvements in the vicinity. <br /> <br />The use would be located in a single-family <br />dwelling. The area is improved completely with <br />streets and sidewalks, which is advantageous for <br />students who would be walking or riding a bicycle <br />to lessons. These improvements provide a measure <br />of safety for the students and creates less <br />potential for interference with other vehicles on <br />the streets. <br /> <br />If operated in accordance with the applicant's plan <br />and the recommended conditions of approval, the <br />piano lessons will not be detrimental to the <br />public, health, safety or welfare. Although some <br />additional vehicular and/or pedestrian traffic may <br />be created by the applicant's clients, the number <br />of lessons permitted each day is limited to six so <br />that the number of vehicular trips to the residence <br />is not excessive and is consistent with a <br />residential use. No changes would be made to the <br />exterior of the structure, and no part of the use <br />would be conducted out of doors. In addition, <br />music lessons are an asset to our community by <br />offering a CUlturally-enriching opportunity. <br /> <br />c. That the proposed conditional use will comply with <br />each of the applicable provisions of this chapter. <br /> <br />The home occupation is required to comply with the <br />conditions of this use permit and those stipulated <br />in Chapter 18.104.30. As with any use permit, the <br />home occupation permit can be suspended or revoked <br />if the conditions are not met. <br /> <br />WHEREAS, projects of this nature are categorically exempt from the <br />requirements of the California Environmental Quality Act <br />(CEQA)i and <br /> <br />WHEREAS, the Planning commission determined that the proposed use, <br />as conditioned, is appropriate for the site. <br /> <br />. . , <br />
