PC-94-49 <br /> <br />RESOLUTION APPROVING A NON-EXEMPT HOME OCCUPATION PERMIT AS <br />FILED UNDER CASE UP-94-57, THE APPLICATION OF GAIL LEW <br /> <br />WHEREAS, Gail Lew has applied for a non-exempt home occupation <br />permit to extend the hours for piano lessons previously- <br />approved with a home occupation permit received in 1987 <br />for 2145 Camino Brazos; and <br /> <br />WHEREAS, zoning for the property is R-1-6500 District; and <br /> <br />WHEREAS, at their duly noticed public hearing of September 14, <br />1994, the Planning commission considered all public <br />testimony, relevant exhibits and recommendations of the <br />City staff concerning this application; and <br /> <br />WHEREAS, the Planning commission made the following findings: <br /> <br />A. That the proposed location of the conditional use <br />is in accordance with the objectives of the zoning <br />ordinance and the purpose of the district in which <br />the site is located. <br /> <br />Chapters 18.32 and 18.36 permit home occupations to <br />be conducted in residences in the R-1 and RM zoning <br />districts, in accordance with Chapter 18.104 (Home <br />Occupations) . Some of the objectives of the R-1 <br />and RM districts are to protect residential <br />properties from the hazards, noise, and congestion <br />created by commercial and industrial traffic, and <br />to protect properties from noise, illumination, <br />unsightliness, odors, dust, dirt and other <br />objectionable influences and hazards. <br /> <br />The objective of Chapter 18.104 is to permit <br />certain home occupations which will not adversely <br />affect the residential character of the <br />neighborhood, yet to permit the conduct of certain <br />activities which normally occur in residences, such <br />as piano lessons. piano lessons are a use which <br />traditionally has been conducted within a <br />residence, particularly private lessons. As <br />conditioned, the use would not generate excessive <br />traffic, parking demand, or noise. By limiting the <br />number of daily lessons, requiring clients to park <br />on the driveway, and asking parents to wait inside <br />the house, the use would be operated in a manner <br />which is consistent with and incidental to the <br />residential use of the property.
