<br />Resolution No. PC-94-32 <br />Page 6 <br /> <br />11. If the proposed grading operations results in the City <br />receiving a substantial number of complaints from surrounding <br />property owners pertaining to noise, dust, vibration, or other <br />impacts, at the discretion of the Planning Director, this <br />conditional use permit may be referred back to the Planning <br />Commission for subsequent review at a public hearing. If <br />necessary, the Planning commission may modify or add <br />conditions of approval to mitigate such impacts, or may revoke <br />said conditional use permit. <br /> <br />12. All grading operations shall be limited to the hours of 8:00 <br />a.m. to 5:00 p.m., Monday through Saturday. All construction <br />equipment must meet DMV noise standards and shall be equipped <br />with muffling devices. <br /> <br />13. The applicant shall arrange and pay for a geotechnical <br />consultant to inspect and approve all geotechnical aspects of <br />project construction. The consultant shall be present on site <br />during grading and excavation operations. The results of the <br />inspections and the as-built conditions of the project shall <br />be certified in writing by the geotechnical consultant for <br />conformance to the approved plans and geotechnical report and <br />submitted to the City Engineer prior to occupancy. Copies of <br />the daily logs of the geotechnical engineer shall be given to <br />the city public works inspector daily. <br /> <br />14. Final inspection of the grading operation including <br />recontouring the construction access/haul road by the Planning <br />Department is required prior to acceptance by the city. <br /> <br />15. The applicant shall submit a final grading and drainage plan <br />prepared by a licensed civil engineer and signed and approved <br />by the geotechnical engineer depicting all final grades and <br />on-site drainage control measures to protect all cut and fill <br />slopes from surface water overflow, and subdrains and backing. <br />This plan shall be subject to the review and approval of the <br />City Engineer and Planning Director prior to the issuance of <br />any grading permits. <br /> <br />16. The applicant shall submit a refundable cash bond for hazard <br />and erosion control prior to issuance of a grading permit. <br />The amount of this bond will be determined by the City <br />Engineer. <br /> <br />17. The developer shall submit a dust control plan or procedure as <br />part of the final grading plans. <br /> <br />II II <br />
