The effective date of this conditional use permit shall <br />coincide with the effective date of PUD modification Case <br />PUD-84-5-4M. If the modification is denied by the City, this <br />conditional use permit shall become void having no further <br />legal force and effect. <br /> <br />2. Grading of the four fill areas and construction access/haul <br />routes shall be substantially as shown on the grading plans <br />and sections, Exhibit "A", dated "Received June 3, 1994" on <br />file with the Planning Department, except as modified by the <br />following conditions. Minor changes to the plans may be <br />allowed subject to the approval of the Planning Director and <br />City Engineer if found to be in substantial conformance to the <br />approved exhibits. <br /> <br />3. The developer shall provide a performance bond to the City <br />guaranteeing the hydroseeding of graded slopes, recontouring <br />of the construction access road/haul route after grading is <br />completed, and repair to graded slopes after grading is <br />completed as shown on the conceptual grading plan or otherwise <br />required as part of this conditional use permit. The develop- <br />er shall provide an itemized cost estimate of said <br />improvements, to be submitted with the bond, for the review <br />and approval by the Planning Director and City Engineer prior <br />to issuance of grading permits. The bond shall be returned to <br />the applicant upon acceptance of the fill sites by the <br />Planning Director and City Engineer. <br /> <br />4. Any damage to existing street improvements during construction <br />on the subject property shall be repaired to the satisfaction <br />of the city Engineer at full expense to the developer. This <br />shall include slurry seal, overlay, or street reconstruction <br />if deemed warranted by the city Engineer. <br /> <br />5. To protect and preserve native oak trees, the developer shall <br />comply with the recommendations of the tree report prepared by <br />Hortscience dated May 3, 1994. These measures would include <br />terminating the fill areas at the oak tree drip lines and <br />installing temporary fences at the edge of their driplines to <br />protect these trees from grading equipment. The developer <br />shall arrange for the horticultural consultant to conduct a <br />field inspection prior to issuance of grading permits to <br />ensure that all recommendations have been properly <br />implemented. The consultant shall certify in writing to the <br />Planning Director that such recommendations have been <br />followed. <br /> <br />II II <br />
