<br />Exhibi~ "A" <br />Conditions or Approval <br />Resolution No. PC-91-10S <br /> <br />1. The proposed development shall conform substantially to the <br />Vesting Tentative Map for Tract 6442 and Grading Plan, <br />Exhibit "A" (dated "Received, November 14, 1991"), on file <br />with the Planning Department, except as modified by these <br />conditions. <br /> <br />2 . <br /> <br />The developer <br />city permits <br />construction. <br /> <br />shall obtain all building and other applicable <br />for the project prior to commencement of <br /> <br />3. This project shall be subject to the Standard Conditions for <br />Tentative Maps, attached hereto and made part of this case by <br />reference. <br /> <br />4. All conditions of approval for Case PUD-81-30-52D, Ordinance <br />No. 1519, shall apply to this project, except as modified by <br />these conditions. <br /> <br />5. The applicant shall record CC&R's (Covenants, Conditions, and <br />Restrictions) at the time of recordation of the final map <br />which shall create a homeowners association for the <br />development. The CC&R's shall be subject to the review and <br />approval of the City Attorney prior to recordation of the <br />final map. The homeowners association shall be responsible <br />for the maintenance of all building exteriors, including roofs <br />and walls, private streets, private utilities, and other <br />common areas and facilities on the site, including all <br />landscaping extending to the face of curb. The city shall be <br />granted the association's rights and remedies, but not the <br />obligation, to enforce the maintenance responsibilities of the <br />homeowners association. <br /> <br />6. The CC&R's shall include, but not be limited to, the following <br />items: <br /> <br />a. Only one homeowners association is allowed to control the <br />subdivision approved under this map; <br /> <br />b. All residents of a portion of the subdivision approved <br />under this map shall have access to and use of all <br />private streets, guest parking areas, common open space, <br />and amenity areas of the subdivision; <br /> <br />c. All project phases of the subdivision approved under this <br />map shall annex into the single homeowners association, <br />and, conversely no deannexations shall be allowed; <br /> <br />d. Private garages shall be included in the homeowners <br />association fire and liability insurance policy; and <br />
