<br />8. This project shall be subject to the recommendations made in <br />the geotechnical investigation by Berlogar Geotechnical <br />Consultants (Geotechnical Investigation, Bonde Ranch, Bernal <br />Avenue, Pleasanton, California for Shapell Industries of <br />Northern California, dated July 25, 1990), amended on <br />September la, 1991, and October 14, 1991, and made part of <br />this case by reference. All recommendations shall be SUbject <br />to approval of the City Engineer and the Director of Planning. <br /> <br />9. Prior to approval of the final map, the developer shall <br />establish a Landscape and Lighting Maintenance District for <br />the entire site. The district shall have sole and full <br />responsibility for the maintenance, inspection, repair, and <br />continual maintenance of landslides, unstable slopes, drainage <br />systems, catch basins, and other geologic hazards as well as <br />street lighting, open space area and fire management areas <br />(including eucalyptus trees), landscaping within public <br />rights-of-way, and masonry soundwalls. The establishment and <br />incorporation of this district shall be subject to the review <br />and approval of the City Attorney, City Engineer, and Director <br />of Planning. <br /> <br />The district's costs shall be divided between the property <br />owners as follows: l) property owners on the north side of <br />Bernal Avenue shall pay for the maintenance of landscaping, <br />lighting, and soundwalls on the northside of Bernal Avenue; <br />and 2) Property owners on the south side of Bernal Avenue <br />shall pay for the maintenance of the landscaping, lighting, <br />and soundwalls along the south side Bernal Avenue and the east <br />side of Independence Drive, as well as maintenance of the open <br />space/fire management areas along Bonde Ridge. <br /> <br />lO. The storm drain line crossing Lot 59 shall be relocated into <br />Arlene Place. <br /> <br />11. Prior to approval of the final map, the developer shall pay to <br />the city the funds necessary to complete construction of <br />Patricia Way from the edge of Lot 95 to the Lund property. <br /> <br />l2. with recordation of the final map, restrictions shall be <br />recorded on Lots 7-10, 47-60, and 7l-l02C indicating the <br />buyers' responsibility to accept storm water runoff from any <br />open space areas. Wording and specific lots to be notified <br />shall be identified to satisfaction of the City Attorney, City <br />Engineer, and the Director of Planning. <br /> <br />l3. With recordation of the final map, the developer shall <br />relinquish all rights of direct access from lots backing up to <br />Bernal Avenue and Independence Drive.
