<br />EMERGENCY VEHICLE ACCESS <br /> <br />30. The final design and detail of the gate for the emergency <br />vehicle access to be located adjacent to Foothill Road shall <br />be submitted for the review and approval by the Planning <br />Director and Fire Marshall prior to the recordation of the <br />Parcel map. Access from this road onto Foothill Road shall <br />only be provided for emergency vehicles and a restriction <br />stating this restricted access onto Foothill Road shall be <br />recorded with the deed for the property prior to the <br />recordation of the Parcel map. The applicant shall install a <br />knox box/lock on the gate as required by the Fire Marshall. <br /> <br />PRIVATE DRIVEWAY TO EXISTING KU RESIDENCE <br /> <br />31. The proposed 20' wide driveway to the Ku residence shall be <br />reduced in width to not exceed 16'. <br /> <br />UTILITIES AND PRIVATE STREET <br /> <br />32. The eastern edge of the 28' wide private street shall be a <br />minimum 30' setback (the same roadway setback in the PUD-88-16 <br />Hempy development) from the future edge of pavement of the <br />ultimate alignment of Foothill Road. <br /> <br />33. The present driveway onto Foothill Road from the project site <br />shall be demolished after the new access road is completed. <br />There shall be no individual driveways or access allowed onto <br />Foothill Road. The parcel map shall reflect this condition. <br /> <br />34. Street lighting shall be provided by the developer and shall <br />be designed to minimize intrusion of hillside lighting to the <br />valley floor to the satisfaction of the Planning Director. <br />The lighting system on the private road shall be approved by <br />the Planning Director and city Engineer, installed by the <br />developer and maintained by the homeowners' association. <br /> <br />35. All of the lot owners in this development shall create and <br />participate in a legal entity responsible for the maintenance <br />and repair of the entire length of the private road that <br />serves this development. This length shall extend from its <br />entrance from Foothill Road to its terminus near the southern <br />property line of this development (Ku). All parties utilizing <br />this roadway (except Kliment as specified in the conditions of <br />approval for PUD-88-16) shall participate in this entity. <br />This entity shall enter into an agreement to hold harmless, <br />defend and indemnify the city, its officers and employees from <br />any cause of action or claim for damage or injury caused by <br />the private roadways, or private utility systems, or their <br />maintenance services, and the party contracted with for <br />maintenance services, and the CC&R' s shall make each homeowner <br />chargeable for costs related to responsibilities provided for <br />in this condition. All lots located in the other subdivisions <br />that utilize this private street shall be granted reciprocal <br />
