A tree report by a certified arborist shall be required to <br />specify requirments for the protection of the oak tree on the <br />starnes' property during the grading of the project site. <br /> <br />RETAINING WALLS <br /> <br />25. All retaining walls shall be limited to five feet in height <br />and shall be stepped, if feasible. If the total height of two <br />retaining walls exceeds five feet, these walls must be <br />separated by a minimum of ten linear feet. <br /> <br />26. All retaining walls visible from Foothill Road shall be faced <br />with natural materials, such as natural stone, wood, etc. <br /> <br />DRIVEWAY EASEMENTS FOR STARNES PROPERTY <br /> <br />27. A 20' wide access easement for the benefit of the southern <br />Starnes property shall be shown on the Minor Subdivision Plan. <br />This driveway easement shall be located across the eastern <br />portion of Lot 2 and shall connect the Starnes property to the <br />proposed private street. Any future driveway in this access <br />easement area shall not exceed 16 feet in width. This <br />ingress/egress easement, in addition to the use of private <br />roadway, shall be recorded for the benefit of the property <br />immediately to the south (Starnes). Prior to the Starnes <br />property taking access to this private road, the City must <br />review and approve this access and the design of the driveway <br />leading to the private road. In the event that the owner of <br />the Starnes property chooses to utilize this 20' driveway <br />easement, the owner would be responsible for the construction <br />of the driveway on this easement. At the time of connection <br />to this private street, the owner of the Starnes parcel would <br />be required to join and participate in the legal entity <br />created for the maintenance and repair of the entire length of <br />the private street. <br /> <br />28. Remove easement to the rear of the Starnes property, which <br />lies in front of Lot 3. <br /> <br />DESIGN GUIDELINES <br /> <br />29. Prior to minor subdivision approval, all modifications and/or <br />changes required by the Design Review Board, Planning <br />Commission, and/or city Council to the Ku Property Design <br />Guidelines shall be combined into a single comprehensive <br />document. This document shall be submitted to the Planning <br />Director for review and approval prior to its publication. <br />The applicant or her successors in interest shall disclose the <br />design guidelines to lot buyers prior to the close of escrow, <br />and shall provide them with copies of the guidelines. <br />
